Report No. GN 96-1 GENERAL ACTION January 30, 1996 COMMISSION AFFIRMS BUREAU DECISION REGARDING LIBERTY CABLE'S REQUEST FOR CONFIDENTIAL TREATMENT OF INFORMATION The Commission has affirmed a decision by the Wireless Telecommunications Bureau which denied a request by Liberty Cable Company, Inc. for confidential treatment of information relating to certain of Liberty's applications for Operational Fixed Microwave Service (OFS). Liberty sought confidential treatment of an internal audit report, along with its attachments, relating to certain OFS applications for which it had requested Special Temporary Authority to operate in New York City. Liberty claimed that the information was protected from disclosure pursuant to Exemption 4 of the Freedom of Information Act (FOIA), the attorney-client privilege and attorney work product doctrine, and in accordance with general privacy concerns. In its application for review, Liberty characterized its privacy argument as one under FOIA Exemption 6, which permits the withholding of "personal and medical files and similar files" where the disclosure of such information would constitute a clearly unwarranted invasion of personal privacy. Affirming the Bureau's decision, the Commission stated that Liberty had failed to demonstrate that the documents at issue are entitled to confidential treatment.
