                   MEMORANDUM OPINION AND ORDER

A  The Commission has under consideration an application for review dated June 19, 1998, by Michael
C. Olson of the decision of the Deputy General Counsel dated May 19, 1998, denying Mr. Olson's
request for a waiver of the fees incurred in processing his requests for documents under the Freedom of
Information Act (FOIA).  Mr. Olson's application for review is dismissed as untimely because it was
filed 31 days after the decision.  See 47 C.F.R.  0.461(j) (applications for review of initial FOIA
matters must be filed within 30 days of the date of the written decision); 47 C.F.R.
 1.4(b)(5) (where a document is not published in the Federal Register, released or described in a
public notice, time is computed from the date appearing in the document); see also Oglesby v. United
States Dep't of the Army, 920 F.2d 57, 65 (D.C. Cir. 1990).

     1.  IT IS ORDERED that Mr. Olson's Application for Review is DISMISSED.  

     2.  The Officials responsible for this action are the following Commissioners:  Chairman
Kennard, Commissioners Ness, Furchtgott-Roth, Powell, and Tristani.
