XQ%-Initiating Parties : N/A  X#'-  Summary: In the Commission's Memorandum Opinion and Order in this proceeding, FCC94-144 (released June 13, 1994), we reaffirmed our brightline crossownership attribution standards, which apply to common ownership of licenses in the Domestic PublicX(0*0*0*'3'# !dx(`lD4l\DDD4DX Cellular Radio Telecommunications Service ("cellular") and the Personal Communications Services in the 2GHz band ("PCS"). We also ruled that no entity would be permitted to hold PCS licenses comprising more than 40MHz of spectrum in a particular PCS service area. In determining how to calculate a party's interest in a cellular licensee when it is held through multiple tiers of entities, we stated that the interest of a subsidiary is attributed in full to the  X-parent. See Memorandum Opinion and Order at 116. The same rule would apply to interests held in PCS licenses through multiple tiers of entities. The attached item would reconsider this decision on the Commission's own motion and adopt a multiplier to be used to calculate whether interests in cellular and PCS licensees held through intervening corporate entities should be attributed. Using a multiplier will more accurately reflect the intent of the PCS/cellular crossownership and PCS spectrum cap rules, and will avoid unduly restricting parties that have neither the ability to exert control over cellular operations nor a substantial financial stake in the cellular or PCS license. We also believe that using a multiplier is consistent with our policy goal of promoting full competition in wireless markets, because it will not cause the exclusion of firms that pose no threat to competition.
