The Commercial Wireless Division granted Western Telepage, Inc.'s (Western's) application for a new paging facility on the 931 MHz band frequency in Crystal Mountain, Washington by Public Notice, Report No. NCS-96-28-A, on May 15, 1996. Although Western had requested the 931.6125 MHz frequency, the Division assigned it the 931.6875 MHz frequency. Commission Rules state that the Commission is not bound by requests for a specific frequency. 2. On May 17, 1996, Western filed a petition for reconsideration, asking the Division to reconsider its grant and assign Western the 931.6125 MHz frequency. On June 5, 1996, by Public Notice, Report No. NCS-96-31-A, in response to the petition for reconsideration, the Division returned Western's application to pending status. 3. The 931.6125 MHz frequency in the Crystal Mountain, Washington area has an existing licensee. Therefore, Western's petition for reconsideration for that frequency must be denied. Since we are unable to grant the petition for reconsideration, we will reprocess Western's application in the next 931 MHz paging applications computer software run. 4. Accordingly, IT IS ORDERED, that pursuant to authority delegated by Sections 4(i) and 303(c) of the Communications Act of 1934, as amended, 47 U.S.C. 154(i), 303(c), the Petition for Reconsideration filed by Western Telepage, Inc. on May 17, 1996 IS DENIED. 5. IT IS FURTHER ORDERED, that pursuant to Sections 4(i) and 303(c) of the Communications Act of 1934, as amended, 47 U.S.C. 154(i), 303(c), the Application filed by Western Telepage, Inc. on February 1, 1995 WILL BE REPROCESSED.
