ORDER

By the Chief, Commercial Wireless Division, Wireless Telecommunications Bureau:

            1.  In this Order we dismiss the petition to deny the above captioned Phase 1 Unserved
Area application in Utah 5, Market 677(B) filed by Carbon RSA Limited Partnership ("Carbon
Partnership") on February 23, 1996 and the petition to deny the above captioned Phase 1
Unserved Area application in Idaho 6, Market 393(B) by the Idaho 6 -Clark Limited Partnership
("Clark Partnership") on May 10, 1996.  By Public Notice of December 21, 1994, we stated
that the above unserved area applications for the Utah 5 and Idaho 6 market were among
numerous Phase 1 Unserved Area applications that would be designated for auction.   Pursuant
to 47 C.F.R.  22.130 (a)(4), petitions to deny are due within 30 days after release of a Public
Notice announcing the tentative selectees.  Petitions to deny filed prior to the release date of the
Public Notice will be dismissed as premature.   

            2.  Accordingly, IT IS ORDERED that pursuant to Section 309(a) of the Communications
Act of 1934, as amended, 47 U.S.C.  309(a), the Petition to Deny filed by Carbon RSA
Limited Partnership on February 23, 1996, IS DISMISSED AS PREMATURE.

            3.  IT IS FURTHER ORDERED that pursuant to Section 309(a) of the Communications
Act, as amended, 47 U.S.C.  309(a), the Petition to Deny filed by Idaho 6 - Clark Limited
Partnership on May 10, 1996, IS DISMISSED AS PREMATURE.

            4.  IT IS FURTHER ORDERED that this action is taken pursuant to delegated authority
under Section 0.331 of the Commission's Rules, 47 C.F.R.  0.331.
