The application for Bismarck was granted on the frequency requested because it did not present a Line A problem.I CommNet did not request a waiver because it mistakenly believed the site was not north of Line A.   x3. In May, 1996, the Wireless Telecommunications Bureau granted CommNet's seven  x applications. However, the Bureau granted the applications for a frequency other than the  X-requested frequency of 931.6375 MHz.}\i {O& -  jԍxPublic Notice, Wireless Narrowband Branch Information, Report No. NCS9628A (released May 15, 1996)  {O - xat 15 (granting six applications); Public Notice, Wireless Narrowband Branch Information, Report No. NCS9629A (released May 22, 1996), at 4 (granting seventh application).}   _x4. In June, 1996, CommNet filed seven Petitions for Reconsideration, one for each  x[application. CommNet argues that its applications "appear[] to have been granted pursuant to  xMthe algorithm in the Bureau's computerized processing run . . . without regard to rule waiver  X - xrequests or other special circumstances." i yO-ԍxPetitions for Reconsideration (of six applications that included waiver requests) at 4. CommNet argues that "the Bureau is still required to  xconsider, on the merits, CommNet's request for waiver of Rule Section 22.531(e)(3) [and] was  xobligated, at the very least, to request that the [Canadian authorities] coordinate CommNet's  X -captioned application.": i {O"-ԍxId.:  X - III. DISCUSSION ĐTP   ]x5. Pursuant to the U.S.Canada Coordination Considerations for the Band 929932 MHz,  xas amended, Section 22.531(e)(3) of the Commission's rules does not allow the frequency  XK- xN931.6375 MHz to be assigned to United States licensees above Line A.K. i yO*-  [ԍx47 C.F.R.  22.531(e). This rule implements the agreements between the American and Canadian regulatory authorities for paging licensing in the border area. A waiver of the  xrestriction would be appropriate only if the proper Canadian authorities approved a coordination request.  X-  X-  !x6. On December 11, 1996, the International Bureau, Planning and Negotiations Division  X- xmade a coordination request on behalf of CommNet to Industry Canada.7Z i {O$-  >ԍxSee Letter from Larry W. Olson, Acting Chief, Planning & Negotiations Division, International Bureau,  xhFCC, to Chris Lafkas, Chief, International Systems, Spectrum Management Operations, Industry Canada (dated Dec. 11, 1996).7 The request included  xan interference study, along with a statement that CommNet's proposed sites would appear not",N(N(ZZ"  X- x/to cause harmful interference to any Canadian operation: i {Oy-ԍxId.:. The coordination request asked  x/Industry Canada to consider CommNet's proposal to determine if the applications could be  X-approved.: Zi {O-ԍxId.:  X-  x7. On January 10, 1997, Industry Canada declined the coordination request.U Zi {OA -  MԍxSee Letter from Chris Lafkas, Chief, International Systems, Spectrum Management Operations, Industry  xCanada, to Larry W. Olson, Acting Chief, Planning & Negotiations Division, International Bureau, Federal Communications Commission (dated Jan. 10, 1997).U It  xexplained that although the interference study indicated that CommNet's proposal should not  xcause interference to Canadian operations, the possibility existed that the proposal could inhibit  X_- xfuture implementation of Canadian operations on 931.6375 MHz.: _i {O-ԍxId.: Thus, Industry Canada  x>declined to approve CommNet's proposal. However, it did state that it would reevaluate its  xNposition if CommNet made arrangements with a Canadian partner to share the requested  X -frequency or another similar one.:  i {Ok-ԍxId.:  X -  IV. CONCLUSION AND ORDERING CLAUSE TP   lx8. Because Industry Canada declined the coordination request, CommNet's Petitions for  xzReconsideration, and its applications for the frequency 931.6375 MHz at the requested sites above Line A, cannot be granted.
