DISCUSSION ă  S * Z  8.` ` As the Commission stated in its Notice, its decision to suspend the acceptance of MAS  vvapplications proposing to provide "subscriberbased" services in the 928/952/956 MHz bands was based  von its proposal to use competitive bidding to award those MAS licenses that met the "subscriberbased"  vtest under the language of former Section 309(j) of the Communications Act of 1934 (the Act), as"9,l(l(,,v"  S* vLamended.\z {Oh* ԍSee Notice, 12 FCC Rcd at 7978, 7995, 800405. Subsequent to the release of the Notice and the filing  {O2* vof the subject applications, Congress amended Section 309(j) of the Act in July 1997. See Balanced Budget Act of 1997, Pub. L. No. 10533, 3002(a)(1), (a)(2)(B)(5), 111 Stat. 251 (1997). Specifically, this section of the Act required the issuance of licenses by competitive bidding  vin cases where the Commission accepted mutually exclusive applications and the use of frequencies  v&involved "the licensee receiving compensation from subscribers in return for which the licensee (i)  venables those subscribers to receive communications signals that are transmitted utilizing frequencies on  vwhich the licensee is licensed to operate; or (ii) enables those subscribers to transmit directly  S* v8communications signals utilizing frequencies on which the licensee is licensed to operate."P z yO *ԍ47 U.S.C. 309(j) (1996). P The  v4legislative history of that provision states that spectrum is auctionable where the licensee "will ... in  S* v,essence, resell the spectrum to subscribers," but not where the spectrum will be put to "private use."!^|z {O * ԍH.R. The  v0Petitioners argue that the dismissal of their applications was erroneous because they did not propose to  vprovide subscriberbased service over the subject MAS frequencies. GTECH administers most of the state lotteries in the United States.E" z yO*ԍGTECH Petition at 1.E Under its  vPcontract with each state, GTECH installs, in retail outlets throughout the state, GTECHowned lottery  S7 * vterminals that are connected to GTECHowned MAS remote stations or private leased telephone lines.@#7 2 z {O *ԍId. at 2.@  vAccording to GTECH, the MAS remote stations communicate with an MAS master station licensed to and  vowned by GTECH, which communicates with GTECH's central data center in Rhode Island by a private  S * vleased line or by a satellite network licensed to, and owned by, GTECH.:$ z {O*ԍId.: GTECH states that it then  v forwards the relevant information, by leased line or satellite network, to its primary data center in the  S8* vstate.:%8V z {O.*ԍId.: Thus, GTECH asserts that it installs, operates (i.e., provides all needed supplies and services),  S* vmaintains, and owns the entire lottery operation.I&z yO *ԍGTECH Supplement at 12.I According to GTECH, the state's lottery agency can  v"monitor certain information regarding lottery operations to verify GTECH's compliance with the contract  vthrough GTECHowned or GTECHleased management terminals located at the primary data center; the  Sm* vzstate's lottery agency, however, cannot communicate over GTECH's MAS facilities.q'Xmxz yO$* ԍGTECH Petition at 2, 5. Because the state agency's only involvement with GTECH's lottery operations  vis through monitoring terminals that are not capable of communicating over GTECH's MAS network, GTECH cannot transmit information of the agency's choosing. GTECH Supplement at 2. q To maintain the"m',l(l(,,"  vLsecurity of its MAS links, GTECH allows only internal communications on the network; it does not resell  S*excess capacity to other entities.M(z yO5*ԍGTECH Petition at 2. M  Sg* Z  10.` ` Based on our review of GTECH's description of its proposed use of the subject MAS  vZfrequencies, we conclude that GTECH does not provide subscriberbased services on these frequencies.  vWe note that GTECH uses MAS frequencies to transmit and receive communications signals, but find that  v^such transmissions and receptions are not the services for which it receives compensation. GTECH's  v4clients contract for lottery management services, and GTECH's use of MAS frequencies is merely "in  Sh* vconnection with and as an adjunct to [that] primary business ... activit[y]."J)hXz yO` *ԍ47 C.F.R.  90.173(d).J As a result, we believe that  v*the nature of GTECH's use of the MAS frequencies is not for the provision of a subscriberbased  v"communications service. Therefore, GTECH's applications should not have been dismissed pursuant to the suspension of acceptance of MAS applications to provide subscriberbased service.  Si * Z : 11.` ` CellNet. CellNet uses its MAS network principally to provide remote meter reading  S7 * vservices to electric and gas utility companies.I*7 z yO*ԍCellNet Petition at 2. I CellNet states that its wireless system contains the  vfollowing elements, all owned by CellNet: (1) numerous endpoints consisting of electric and gas utility  v"meters retrofitted with unlicensed Part 15 spread spectrum transmitters; (2) "MicroCell Controllers" (the  vMAS remote stations), which are designed to collect the data from up to 750 endpoints; and (3)  Sk* v"CellMasters" (the MAS master stations).B+kxz {O*ԍId. at 34.B According to CellNet, the MicroCell Controllers collect the  S8* vdata transmitted by the utility's retrofitted meters, and then transmit the data to the CellMasters.@,8 z {O*ԍId. at 4.@ The  vCellMasters transmit the collected data, using dedicated landline, fiber, or fixed microwave facilities, to  S* vthe CellNet Operations Center, which consists of several manned computer workstations.:-z {O*ԍId.: CellNet  vexplains that once it retrieves the raw data, it processes and formats the data, then makes the processed  vdata available to the CellNet customer (a utility) at the Operations Center, on a query basis, in an  S9*enhanced form, using proprietary software and standard TCP/IP protocols. .^9. z {O* ԍId. Transmission Control Protocol/Internet Protocol ("TCP/IP") enables communications between private  {O* vand public networks running over any medium and over any kind of computer. See In the Matter of FederalState  {O *Joint Board on Universal Service, CC Docket No. 9645, Recommended Decision, 12 FCC Rcd 87, 321 (1997).  S* Z  12.` ` Similar to GTECH, CellNet only uses MAS frequencies as a tool in the provision of its  vprimary business activity the provision of data developed in the monitoring of endpoints over its  Sm* vnetwork.@/mT z {Oa%*ԍId. at 4.@ CellNet does not receive compensation specifically for the transmission of communications  vsignals. Rather, CellNet is paid for providing a meter reading service, including data processing,  vformatting and storage, to its utility customers. The CellNet customer is not offered direct access to or"/,l(l(,,|"  vthe use of the CellNet MAS network, nor does CellNet transmit information of the customer's choosing.  vRather, the collected data can only be accessed by the utility customer when the data reaches CellNet's  v8database. Thus, we believe that the nature of CellNet's use of the MAS frequencies is not for the  vprovision of a subscriberbased communications service. Therefore, CellNet's application should not have  vbeen dismissed pursuant to the suspension of acceptance of MAS applications to provide subscriberbased service.  S* Z 6 13.` ` Radscan. Radscan provides security alarm monitoring services to central station alarm  vbmonitoring companies, such as ADT Security Systems and Wells Fargo Alarm Services, that offer  S6* vtraditional wireline alarm monitoring services to the public.H06z yO *ԍRadscan Petition at 2. H Radscan's wireless service supplements and  S* venhances the reliability of central station alarm services.:1Xz {O *ԍId.: According to Radscan, in each area that  S* vRadscan serves, it constructs a network of master stations with overlapping service contours.:2z {OZ*ԍId.: Radscan  vdescribes its master stations as freestanding, multimicroprocessor systems capable of responding to  vtransmissions of remote units, decoding messages, validating transmitted codes, buffering and screening  vclasses of messages, transmitting to remotes, communicating with other master stations, and  S * vlcommunicating by backup telephone modem with central stations.:3 |z {O *ԍId.: Remote units, purchased by the  vhousehold resident, are either twoway transceivers polled by master stations, or oneway transmitters that  S * vare programmed to send messages to master stations at certain intervals.:4 z {OL*ԍId.:  Although twoway transceivers  vthus exist on Radscan's MAS network, Radscan notes that the information transmitted along the network  S9* vis not of the subscriber's choosing.B59z {Oy*ԍId. at 89.B Radscan adds that its subscribers have no ability to communicate  S* vinformation on the network.:62 z {O*ԍId.: Radscan explains that if a master station receives an alarm signal or loses  v>contact with a remote unit, it sends a signal to the appropriate central station, at which point appropriate  S* vpublic safety officials may be alerted.@7 z {O*ԍId. at 2.@ Radscan contends that over 99 percent of the system traffic on  v,the Radscan network consists of internally generated polling and status messages from remotes to masters,  S:* vmasters to remotes, and between master stations.:8:V z {O0"*ԍId.: Less than one percent of all communications pass from  va remote unit at a customer's premises to a central station alarm company. Further, according to Radscan,  vPeven those messages undergo processing and are altered in form before they are sent on to the alarm  S*company.B9z {O)&*ԍId. at 23.B "nz9,l(l(,,"Ԍ S* Z  14.` ` Radscan does not merely play the role of a conduit by enabling subscribers to receive or  vdirectly transmit communications signals in return for compensation, nor does Radscan resell spectrum  vto subscribers. Radscan's primary business activity is providing an alarm monitoring service to central  vPstation alarm monitoring companies. In Radscan's operations, the MAS signal (or lack thereof) is not  vrouted directly through Radscan without any conversion. Rather, as described above, the Radscan master  v0station responds to and decodes messages from remote units, validates transmitted codes with both the  vtransmitting remote unit and with adjacent master stations, and communicates by backup telephone  vmodem with central stations should a loss of contact occur with the remote unit signal. In sum, the  vRadscan MAS master stations are equipped with builtin intelligence. Radscan's subscribers compensate  v^Radscan not for a communications service, but for an alarm monitoring service. Radscan merely uses  v^MAS spectrum in the course of providing this monitoring service. Consequently, we believe that the  vfnature of Radscan's use of the MAS frequencies is not for the provision of a subscriberbased  v"communications service. Therefore, Radscan's application should not have been dismissed pursuant to the suspension of acceptance of MAS applications to provide subscriberbased service.  S * Z j15.` ` TeleBeeper. TeleBeeper, a provider of Part 90 paging services, seeks the MAS frequencies  S * vat issue for use as internal "links" to control its paging base stations.:" z {O9* ԍSee TeleBeeper Petition at 2. Part 22 of the FCC Rules defines a "control transmitter" as "a fixed  vtransmitter in the Public Mobile Services that transmits control signals to one or more base or fixed stations for the  vpurpose of controlling the operation of the base or fixed stations, and/or transmits subscriber communications to one or more base or fixed stations that retransmit them to subscribers." 47 C.F.R.  22.99. The commercial paging service  S * vHit offers to subscribers is carried over separatelylicensed base station frequencies.; z yO* ԍTeleBeeper Petition at 4. TeleBeeper's current paging operations are under call signs WPFD249, WPFX850, WNGT992 and WPGN838. Telebeeper states that  v"it would use the MAS links to transmit control sequence tones to its paging base station transmitters to  S8* v"key up" those transmitters.<8 z yO* ԍTeleBeeper Supplement (Declaration of Dallas Vanderhoof). TeleBeeper claims that each of the requested  {O*MAS links will control six base station transmitters. Id. According to TeleBeeper, these MAS link stations would not communicate  vdirectly with subscribers, but rather would activate and control its paging system base stations, signalling  S* vthe base stations to transmit a signal to a specific pager.:=d z {O*ԍId.: TeleBeeper explains that the subscriber's paging  vNunit is not capable of receiving a signal on the MAS frequencies nor would any subscriber  Sl*communications be carried over the requested MAS frequencies.L>l z yO*ԍTeleBeeper Supplement at 1.L  S* Z @16.` ` The Commission's Rules indicate that control transmitters may or may not carry subscriber  S* vcommunications.F? z yO"*ԍ47 C.F.R.  22.99.F For example, one licensee may carry subscriber traffic on its control channels, whereas  v0another may not. In this case, TeleBeeper represents that the actual communications message delivered  Sm* vhto the subscriber at no point will be transmitted over the requested MAS channels.j@mz yO#&*ԍTeleBeeper Supplement (Declaration of Dallas Vanderhoof).j We therefore agree  vVwith TeleBeeper that, for the limited purpose of the suspension of acceptance of MAS applications adopted":@,l(l(,,"  S* vin the Notice, its proposed use of the MAS frequencies is not subscriberbased. Unlike its commercial  v"use of paging base station frequencies, TeleBeeper uses MAS frequencies solely for transmitter control  S* vzpurposes and not to transmit subscriber communications to one or more paging base stations.Az {O*ԍSee 47 U.S.C.  309(j)(2)(A) (1996); Competitive Bidding Second Report and Order, 9 FCC Rcd at 2348. As a  vresult, TeleBeeper's application should not have been dismissed pursuant to the suspension of acceptance of MAS applications to provide subscriberbased service.  S* Z (17.` ` Unicom. Unicom, a provider of paging services, seeks the subject license modification  vin order to continue to use its MAS facilities as internal links to activate and control its Part 90 paging  Sj* vbase stations in and around the Charleston, South Carolina area.FBjZz yOd *ԍUnicom Petition at 2.F Like TeleBeeper, the commercial  S7* vpaging service it offers to subscribers is carried over separatelylicensed base station frequencies.@C7z {O *ԍId. at 6.@  vAccording to Unicom, the MAS link stations do not communicate directly with subscribers and no  S*subscriber traffic is carried on the subject MAS station.nD|z {O*ԍId.; see also Unicom STA Extension Request at 2. n  Sk * Z N18.` ` As with TeleBeeper, Unicom represents that the actual communications message delivered  S8 * vhto the subscriber at no point will be transmitted over the requested MAS channels.SE8 z yO*ԍUnicom STA Extension Request at 2.S We therefore agree  vLwith Unicom that, for the limited purpose of the suspension of acceptance of MAS applications adopted  S * vin the Notice, its proposed use of the MAS frequencies is not subscriberbased. Unlike its use of paging  v>base station frequencies, Unicom uses MAS frequencies solely for transmitter control purposes and not  Sm* vto transmit subscriber communications to one or more paging base stations.Fmz {O*ԍSee 47 U.S.C.  309(j)(2)(A) (1996); Competitive Bidding Second Report and Order, 9 FCC Rcd at 2348. As a result, Unicom's  vapplication for modification should not have been dismissed pursuant to the suspension of acceptance of MAS applications to provide subscriberbased service.  S*/ IV. CONCLUSION ă  S;* Z 19.` ` We find that the subject MAS applications of GTECH, CellNet, Radscan, TeleBeeper, and  vUnicom to operate on the 928/952/956 MHz bands should not have been dismissed pursuant to the  vrCommissionimposed suspension of the acceptance of applications for licenses to provide subscriberbased  vservice in these bands, because the Petitioners do not propose to use the subject MAS frequencies for the  vprovision of subscriberbased services. We, therefore, grant the petitions for reconsideration and reinstate  S<*those applications nunc pro tunc.  S* V.
