Rockwell's hypothetical situation in which two radios would be used, one with  x25kHz channel spacing, the other with 8.33kHz channel spacing, could not be realized consistent with the  xxCommission's Rules. A separate transceiver with 8.33kHz channel spacing could not be type accepted because !  xas with the transceivers for which a waiver is sought herein ! such a separate transceiver would not conform to  xSection 87.173(b) of the Rules which specifies only 25 kHzspaced channels. Even if the aircraft supplier were to  {O- xobtain an 8.33kHz channel transceiver from another source, e.g. a European manufacturer, the separate transceiver  xJstill could not be used because Section 87.39 of our Rules requires that U.S. registered aircraft use only type accepted radios.   S -  ?x6. After reviewing Rockwell's waiver request, we find that good cause has been shown for waiver  xofS Section 87.173(b) of the Commission's Rules. First, we note that without the capability to transmit  xon 8.33kHz spaced channels, U.S. registered aircraft would be unable to communicate effectively with  xATC facilities in certain European countries beginning in 1999. Second, we note the FAA's and the  xindustry's apparent recognition of the need for U.S. registered aircraft to continue operations in the  S- xairspace of the implementing European countries.QRp {OZ!-ԍxSee Waiver Request at 23.Q Thus, we conclude that the public interest will be  xserved by waiving Section 87.173(b) to permit the type acceptance of the specific models of dual spacing  S8- xtransceivers, infra, for use by U.S. registered aircraft in countries employing 8.33 kHz spaced AMS  xchannels. We note that our action here does not constitute authorization for aeronautical use of any frequencies not listed in Section 87.173(b) within United States' airspace.
