Both Orion and PSI serve the Atlantic, Pacific, and Hawaiian coastlines and have  {O - xYapplications pending before the Commission to provide service to a portion of the Great Lakes. See Second Report  {Oz -and Order and Second Further Notice, 12 FCC Rcd at 17005.   ?x3.ؠOn November 6, 1997, Kenwood filed an application, on FCC Form 731, for type acceptance  S5- xof an AMTS transceiver, discussed infra, for use on public correspondence channels.50 yOs-  ԍxApplication for Equipment Authorization filed by Kenwood Communications Corporation (Nov. 6, 1997) (Kenwood Application). This transceiver  S- xoperates in the 219220 MHz band, and is for AMTS use only.s 0 {O-ԍxSee Kenwood Application; see also Waiver Request at 1.s Because Kenwood's transceiver does not  xincorporate a frontpanel power reduction control, Kenwood has requested waiver of Sections 80.215(e)(2)  xand (i) of the Commission's Rules. Sections 80.215(e)(2) and (i) require VHF transceivers in the 216220  Sj -MHz band to have a frontpanel control capable of reducing carrier power to 2.5 watts.c j 0 {O-ԍxSee 47 C.F.R.  80.215(e)(2) and (i).c  S -  x4.ؠSection 80.43 of the Commission's Rules specifies that all transmitters used in the Maritime  xService must be type accepted for a particular use by the Commission based upon technical requirements  S - xcontained in Subparts E and F of Part 80 of the Commission's Rules.F 0 yOX-ԍx47 C.F.R.  80.43.F Subpart E of the Commission's  xRules, namely, Sections 80.215(e)(2) and (i), requires that transmitters in the 216220 MHz band  xincluding the AMTS frequencies have "the capability to reduce the carrier power to 2.5 watts with a  S- xLfrontpanel control."c 0 {OO!-ԍxSee 47 C.F.R.  80.215(e)(2) and (i).c Accordingly, absent a waiver, the Kenwood transceiver at issue here could not be type accepted under Part 80 and, hence, could not be used for maritime communications. DISCUSSION T  S-  ^TP x5.ؠSection 1.3 of the Commission's Rules permits waiver of any rule provision for good cause  Sg- x-shown. g0 {O-ԍx47 C.F.R.  1.3; see also WAIT Radio v. FCC, 418 F. 2d 1153, 1159 (D.C. Cir. 1969). We find that Kenwood has made the requisite showing. Kenwood notes that AMTS transceivers  xare part of an integrated, automated duplex communication system requiring little or no manipulation of  S- xjcontrols by the shipboard operator.E Z0 yO-ԍxWaiver Request at 1.E In that respect, AMTS shipboard units are similar to conventional  xmarine VHF stations which are limited to public correspondence and used in automated systems. We note  xthat the Commission's Rules do not require a frontpanel power control for such automated stations in the  Sh- x156162 MHz band.[h0 {O -ԍxSee 47 C.F.R.  80.215(e)(1) n.6.[ Moreover, the requirement of a frontpanel power control for marine VHF stations  xoperating in other spectrum bands does not appear necessary for purposes of avoiding harmful interference  x[in the case of AMTS transceivers. As Kenwood states, AMTS base stations are typically located away  S- xfrom harbor areas and are designed for wide area coverage.Q|0 yO-ԍxWaiver Request at 1.Q This requires the shipboard station to  x[operate at full power for reliable communication. Moreover, we observe that AMTS signals have a very  xmimimal potential for objectionable interstation interference, even at full power, because: (a) currently  xthere are only three AMTS licensees; (b) only two stations, at most, are licensed to operate in a particular  xjAMTS geographic region; and (c) AMTS channels are licensed on an exclusive rather than a shared basis.   {x6.ؠAccordingly, we agree with Kenwood that requiring a manual power control on the frontpanel  x=of an AMTS transceiver, which operates as part of an otherwise fully automated and integrated system,  S- xwill only add complexity and cost without concomitant technical benefit.M 0 {O-ԍxSee Id.` ` M In this connection, we also  xnote that other comparable commericial mobile radio services (CMRS) providers, such as cellular, Personal  xCommunications Services, and Specialized Mobile Radio, are not required to incorporate such a control  xLin their transceivers. Therefore, we find that  S-Kenwood's Waiver Request should be granted.@$0 yO5-  kԍxWe note that the Comments of Fred Daniel d/b/a Orion Telecom (Orion Comments), filed in response to  {O- xthe Second Report and Order and Second Further Notice, urge deletion of the frontpanel power control requirement  {O- xfor AMTS transceivers. See Orion Comments at 4. We note that our decision here does not prejudge the outstanding issues in that proceeding. Thus, we note that our decision may be affected by the outcome of that proceeding.@  Sg- IV. CONCLUSION ĐTP  S-  x7.ؠWe conclude that the public interest will be served by waiving Sections 80.215(e)(2) and (i)  xof the Commission's Rules to permit the type acceptance of the specific Part 80 AMTS transceiver model,  S- xlisted infra. We note that our action here does not constitute authorization for type acceptance of any  xjother transceiver not employing a frontpanel power control, whether manufactured by Kenwood or any other entity.
