SCANA also holds a minority ownership interest in Powertel, a Commission licensee that provides PCS and cellular service in the southeastern United States.   x4. SCANA presently holds 122 Commission authorizations for private radio, microwave and other  x=facilities. These authorizations enable SCANA to conduct its core business as a regulated public utility,  xkand some of the authorizations are utilized on a Public Safety Network in order to provide health and  xsafety agencies with vital radio communication services and provide communications services for SCANA and other power utilities.   {x5. On March 22, 1996, SCANA voluntarily disclosed to the Division certain Commissionrelated  xjlicensing irregularities that inhouse counsel for SCANA had discovered within a SCANA whollyowned  xand operated subsidiary called MPX Systems, Inc. (MPX Systems, Inc., hereinafter referred to as "MPX,"  xis now called SCANA Communications, Inc.). A subsequent investigation disclosed evidence indicating  xlthat officials within MPX may have engaged in a scheme whereby they arranged for certain MPX  xemployees and other nominees ("nominees") to apply for fiftyone 800 MHz SMR authorizations in their  X,'- xown names for ultimate use by MPX. #XN\  Py XP#The MPX officials apparently intended for MPX to be the  x-undisclosed realpartyininterest in the applications and to acquire authorizations that MPX was"(,))qq)"  xnot otherwise eligible to obtain because of loading restrictions. The Commission, unaware of  x=MPX's involvement in the applications, granted 20 licenses to the various nominees. Thirteen  xof the authorizations were subsequently assigned from the nominees to MPX. The investigation  xalso indicated that MPX officials may have filed false loading reports and false construction  xxletters with the Commission and failed to return unconstructed licenses. The investigation further  xrevealed evidence that MPX and SCE&G may have allowed noneligible users (most of which  xjwere public safety entities) to use MPX's Industrial/Land Transportation ("I/LT") facilities and  ximarketed services using I/LT facilities to nonI/LT businesses. The investigation further revealed  xmore than three dozen instances of apparent violations, including operating a station without  x proper authorization, failing to construct timely, filing inaccurate construction notices, and  ximproperly lighting or painting a transmission tower. SCANA fully cooperated with the Division and the Bureau throughout the investigation.   x6. SCANA has represented to the Division, and the Division has confirmed to the extent  xpossible, that SCANA has taken the following actions subsequent to bringing this matter to the Division's attention:  AXxa. All of the authorizations that were obtained by nominees on behalf of SCANA have been surrendered to the Commission.   Xxb. Four MPX officials who apparently were involved in the abovereferenced  ~scheme have been terminated from SCANA's employ, and two SCE&G officials  4who appear to have played subordinate roles in the misconduct have been reassigned to positions not involving Commission licenses. SCANA subsidiaries may have willfully violated Section 90.603(a) of the  Commission's Rules, 47 C.F.R. 90.603(a), by permitting ineligible individuals to operate on certain frequencies; and   Xxf. SCANA subsidiaries may have willfully violated Section 90.179(f) of the  Commission's Rules, 47 C.F.R. 90.179(f), by allowing forprofit use of certain frequencies for which only nonprofit use is permitted.    x12.
