Frenzel, III ) Motion to Stay Expiration of ) Licenses Pending Commission ) Decision on Waiver Request ) ORDER Adopted: December 20, 1996Released: December 20, 1996 By the Chief, Commercial Wireless Division, Wireless Telecommunications Bureau: 1. On December 17, 1996, Otto N. Frenzel, III (Frenzel), a licensee in the Location and Monitoring Service (LMS), filed a request for extension of the construction deadline applicable to his LMS systems under Section 90.363(d) of the Commission's rules. The current construction deadline for the systems in question is January 1, 1997. Frenzel seeks an extension of the deadline until April 1, 1997 for the systems for which he is now the named licensee. 2. On December 19, 1996, Frenzel, MobileVision, L.P. and Mets, Inc. filed a request for stay of Section 90.363(d) pending a decision on the December 17 waiver request. We conclude that it is appropriate to grant the requested stay to afford Commission staff sufficient time to fully consider the issues raised by Frenzel. We will therefore stay the expiration of the multilateration LMS licenses at issue until an Order is released resolving the December 17 waiver request. 3. Accordingly, IT IS ORDERED that the Motion to Stay Expiration of Licenses Pending Commission Decision on Waiver Request, filed by MobileVision, L.P., Otto N. Frenzel, III and Mets, Inc. on December 19, 1996 IS GRANTED to the extent stated herein. 4.
