California has requested confidential treatment of these materials. Also, Hawaii and New York have offered to provide supplemental materials on a confidentiality basis. These procedures are expected to expedite the disposition of these proceedings, which pursuant to Section 332(c)(3)(B) of the Communications Act must be concluded within 12 months of the date that each petition was filed. SS}The Bureau adopted a model protective order that it will use to provide parties with access to confidential materials in PR Docket No. 94105 (California), and in PR Docket Nos. 94103 (Hawaii) and 94108 (New York), if Hawaii and New York choose to make supplemental filings of confidential material. This protective order was crafted with input from parties after notice of the proposed provisions to all parties in this proceeding. The terms of this protective order will be adopted to govern treatment of confidential materials submitted by other states that seek to retain rate regulatory authority over commercial mobile radio service. SS}In addition, to govern confidential filings submitted by two Connecticut cellular carriers and the state of Connecticut, the Bureau adopted the terms of a protective order already in force in that state's proceeding. >(over)XY(,**XX;.3X !X  ? X SS}Although the model protective order will permit limited disclosure of most of the information subject to the California request, certain data elements will not be disclosed because they are particularly competitively sensitive and not material to California's statutory demonstration. In certain other respects, the Order denies California's request for procedural reasons. If California wishes, it may refile the defective portion of its request, with supporting materials that comply with Section 20.13 of the Commission's Rules, and a request for  ?<confidential treatment, no later than January 30, 1995 . California is required to submit amended versions of its  ?<Petition and Appendices no later than January 30, 1995. SS} SS}Neither Hawaii nor New York submitted confidential materials. If New York and Hawaii wish, they may submit the supplemental materials mentioned in their petitions, accompanied by a request for confidential treatment, in accordance with Sections 0.457, 0.459 and 0.461 of the Rules, no later than  ?< January 30, 1995 . This quick turnaround is necessary if the Commission is to meet its statutory deadline. The Bureau expects to rule sufficiently promptly on any such submissions, and on the recently amended filing of confidential materials by the state of Connecticut, to maintain the schedule for comments and replies established today in its Order, and so expedite these proceedings. SS}California filed an emergency motion to compel production of data underlying the affidavits of Dr. Jerry Hausman that were filed in support of the Cellular Telecommunications Industry Association (CTIA) and AirTouch Communications (AirTouch) Oppositions to the California petition, and filed a motion to strike the Hausman affidavit attached to the CTIA Opposition, for failure to include the data underlying Hausman's analysis. The Bureau Order dismisses California's motions in this regard. It notes, however, that if AirTouch and CTIA wish the Commission to consider Hausman's analysis in its substantive review of California's petition, those carriers must provide the Commission with the underlying data used to conduct Hausman's analysis, accompanied by a request for confidential treatment if appropriate pursuant to Sections 0.457, 0.549 and 0.461 of the Commission's Rules, 47 C.F.R.  0.457, 0.549 and 0.461, by  ? < January 30, 1995. SS}If counsel for parties in PR Docket Nos. 94105, 94103, 94106, and 94108 elect to inspect unredacted materials submitted by the States of California, Connecticut, Hawaii or New York, or by AirTouch or CTIA, such counsel shall execute and comply with the relevant protective order, and with the related provisions of the procedural Order.
