DA 96-319 March 8, 1996 WIRELESS TELECOMMUNICATIONS BUREAU SEEKS COMMENT ON FLASH COMM, INC.'S REQUEST FOR WAIVER OF THE COMMISSION'S RULES REGARDING ITS APPLICATION FOR AUTHORIZATION IN THE HIGH FREQUENCY BAND On February 9, 1996, Flash Comm, Inc., filed a request for waiver of three Sections of the Commission's Part 90 Rules. First, Flash Comm seeks a waiver of the emissions designator limitations of Section 90.266(f) to allow it to utilize an interference-minimizing "stealth" digital waveform developed originally for military applications. Second, Flash Comm seeks a waiver of the station identification rules of Section 90.425 to avoid extending the length of its "burst" transmissions and instead proposes a recordkeeping requirement to resolve any potential interference complaints. Third, Flash Comm seeks a waiver of type acceptance required by Section 90.203 to avoid the administrative burden required to process type acceptance applications for a service authorized under waivers In addition, Flash Comm requests authority to provide third party service to eligibles, or, alternatively, confirmation that future applications by eligibles consistent with its proposal would be routinely granted. Flash Comm seeks a blanket authorization to utilize fixed and land mobile bands approved for Part 90 use in the High Frequency (HF) spectrum anywhere in the coterminous United States. Further, it requests a blanket PMRS authorization that would permit it to serve any eligible users under Part 90, as well as the federal government, on a third party, for-profit basis. The Wireless Telecommunications Bureau is reviewing Flash Comm's request to determine whether it meets the waiver criteria set forth in the Commission's rules and whether the request is consistent with the Commission's public interest goals. Comments should be filed on or before April 8, 1996; reply comments should be filed on or before April 23, 1996.
