WASHINGTON, D.C. 20554 DA 96-1571 News media information 202/418-0500 Fax-On-Demand 202/418-2830 Internet: http://www.fcc.gov ftp.fcc.gov Released: September 18, 1996 WIRELESS TELECOMMUNICATIONS BUREAU CLARIFIES INTERIM LICENSING RULES APPLICABLE TO ADDITION OF INTERNAL SITES BY 929 MHz NATIONWIDE LICENSEES Under our interim licensing rules adopted in the Notice of Proposed Rulemaking in WT Docket No. 96-18, released February 9, 1996 (Notice), incumbent paging licensees on 931 MHz and exclusive 929 MHz channels may add sites to existing systems or modify existing sites during the pendency of the rulemaking proceeding without prior Commission approval, provided that the addition or modification does not expand the interference contour of the incumbent's existing system. See Notice at para. 140. By this Public Notice, the Wireless Telecommunications Bureau clarifies that this interim procedure applies to those 929 MHz licensees identified by prior Public Notice as having met the construction requirements for nationwide exclusivity under Section 90.495(a)(3). Under our interim procedures, these licensees may add or modify sites to their systems on a nationwide basis consistent with the requirements of Part 90, Subpart P. We do not consider the addition of such sites to "expand" a nationwide licensee's existing interference contour, because the licensee has already obtained protection from interference on a nationwide basis, and addition of new or modified sites does not affect spectrum availability to others. Therefore, we will allow 929 MHz nationwide licensees to add to or modify their systems without prior application to or approval by the Commission. This clarification also conforms our interim procedures for 929 MHz nationwide licensees to those for 931 MHz nationwide paging licensees operating under Part 22 of the Commission's rules.
