CL-97-4 On August 14, 1996, by Memorandum Opinion & Order ("MO&O") the Commission vacated and rescinded MobileTel, Inc's., ("MobileTel") authorization to construct and operate a cellular system in Rural Service Area ("RSA") Market No. 461 (Block B), Louisiana 8 - St. James, and RSA Area Market No. 462 (Block B), Louisiana 9 - Plaquemines. The Commission directed the staff to award the licenses for these markets in accordance with the processing rules in effect at the time of the original Bureau decision in this matter. In Market No. 461 the remaining applicants are BellSouth Mobility, Inc., ("BellSouth") and Columbia Cellular, Inc., ("Columbia"). BellSouth and Columbia have previously indicated that they have entered into a settlement agreement under which the settled entity will be the sole remaining applicant in Market No. 461. In Market No. 462 BellSouth is the sole remaining applicant. By this Public Notice, we announce the licensing procedures governing the remaining applicants in these markets. Within seven (7) days of this Public Notice, the remaining applicants must re-submit their original applications to the Commission. Applications should be submitted in microfiche and hard copy form, consisting of an original and two paper copies of the application. See 47 C.F.R.  1.49 and 47 C.F.R.  22.953(a)(1). There will be no additional filing fee. Within thirty (30) days of this Public Notice, applicants must file any Section 1.65 amendments to their applications and, in the case of Market No. 461, shall submit the settlement agreement between BellSouth and Columbia. See 47 C.F.R.  1.65. File Numbers 00141-CL-P-461-B-97 and 00142-CL-P-461-B-97 have been assigned to BellSouth and Columbia, respectively, in Market No. 461. File Number 00140-CL-P-462-B-97 has been assigned to the BellSouth in Market No. 462. Any amendments or correspondence to be associated with the applications should specify the above file number(s). After the receipt of amendments referenced above, the staff will promptly issue a public notice to establish a 30-day period for Petitions to Deny. This is a restricted proceeding under the ex parte rules. See 47 C.F.R.  1.1208. For purposes of the ex parte rules, the Commission will continue to treat this proceeding as one consolidated proceeding involving both Markets 461 and 462. MobileTel, BellSouth, and Columbia remain parties to the consolidated proceeding for this purpose.
