       ANNOUNCEMENT OF DISMISSAL OF PHASE 1 RSA APPLICATION, NON-
                      WIRELINE TENTATIVE SELECTEES

The following sole application was accepted for filing as a tentative selectee for certain Phase
I unserved areas in Public Notice Report No. CL-97-17 released December 7, 1995.  Upon
review of this application, the Commission has determined that the service area boundary of the
cell site proposed in the application extends into the protected Cellular Geographic Service Area
of the co-channel incumbent licensee.  Thus, the application does not comply with Section
22.949(a)(1)(iii) of the Commission Rules, 47 C.F.R.  22.949(a)(1)(iii), and is therefore
dismissed without prejudice as defective pursuant to Section 22.128(d)(2) of the Commission
Rules, 47 C.F.R.  22.128(d)(2).
