The Commercial Wireless Division (CWD) of the Wireless Telecommunications Bureau announces procedures for the efficient processing of transfer and assignment applications subject to the Unjust Enrichment provisions in Section 1.2111 of the Commission's rules, 47 C.F.R.  1.2111. Effective immediately, all CMRS pro forma and non pro forma transfer and assignment applications which are subject to the Unjust Enrichment provisions in Section 1.2111 of the Commission's rules, 47 C.F.R.  1.2111 will be processed as quickly as possible, but no earlier than 90 days from the filing date of the application. Normally, a pro forma transfer or assignment application is processed within 30 days, a non pro forma transfer or assignment application is processed within 75 days of the filing date if no petition is filed against the application. However, CWD needs additional time to process CMRS applications which are subject to the Unjust Enrichment provisions of 47 C.F.R.  1.2111 because CWD must coordinate the approval of loan documentation with the parties to the application and the U. S. Treasury. Thus, CWD urges transfer and assignment applicants to coordinate the proposed closing date of the transaction with the Legal Branch and the CWD Customer Service Specialist as soon as the date is known to the applicants. The processing of pro forma and non pro forma transfer and assignment applications for CMRS transfer and assignment applications which are not subject to the Unjust Enrichment provisions in 47 C.F.R.  1.2111 will be handled as previously described in CWD Public Notice, DA 95-126, January 31, 1995.
