Commercial Wireless Division Approves Settlements Among Maine RSA #4 Limited Partnership and MRCC d/b/a Unicel In Market 466B, Maine 4 - Washington RSA By the Chief, Commercial Wireless Division: On August 29, 1995, Maine RSA #4 Limited Partnership ("Partnership"), the wireline cellular licensee of Maine RSA no. 4, filed an FCC Form 401, major modification application, file number 07129-CL-MP-95, in Market no. 466B, Maine RSA 4, which appeared on Public Notice on September 19, 1995. Public Notice, Report No. CL-95-137 (rel. Sept. 19, 1995). On October 18, 1995, MRCC d/b/a Unicel ("MRCC") filed a Petition to Deny the Partnership's August 29, 1995 application. On October 18, 1995, MRCC, the wireline cellular licensee of Markets 224B - Bangor, Maine, Maine RSA no. 2 and Maine RSA no. 3, filed a Phase I application in Maine RSA no. 4, file number 00538-CL-P1-96 which appeared on Public Notice on November 6, 1995. Public Notice, Report No. CL-96-96 (rel. Nov. 6, 1995). The Partnership filed a Petition to Deny MRCC's Phase I application on December 7, 1995. On January 5, 1998, both the Partnership and MRCC filed Motions to Dismiss their respective Petitions to Deny, requesting approval of a settlement agreement and withdrawals of their Petitions to Deny. The Partnership and MRCC have agreed that MRCC will withdraw its Phase I application. The Partnership has agreed to give its consent to service area boundary (SAB) extensions into Maine RSA no. 4 from certain MRCC cell sites, as outlined in the extension agreement, attached to the settlement agreement. The Division has reviewed the Petitions to Deny, the settlement agreement, and the dismissals of the Petitions to Deny and finds that they raise no substantial or material questions of fact under 47 U.S.C.  309. The Division has further reviewed the requests for approval of the settlement agreement, the settlement agreement, and the declarations outlining the terms of the settlement agreements. The Division finds that these agreements comport with the requirements of Section 22.129 of the Commission's rules, 47 C.F.R.  22.129, and that approval of the agreement would be in the public interest. Accordingly, the settlement agreement is hereby approved, and the Petitions to Deny, filed by the Partnership and MRCC, respectively, are dismissed. The Partnership's application, file number 07129-CL-MP-95, is hereby granted, effective March 26, 1998. MRCC's Phase I application, file number 00538-CL-P1-96, is hereby dismissed, effective March 26, 1998.
