A Petition to Deny (Petition) was filed by McElroy Electronics Corp. (McElroy). JAJ Celllular, Inc. (JAJ) and McElroy filed competing applications for the unserved areas in the Phoenix market. In 1989, Phoenix filed a major amendment to its major modification application, 04376-CL-MP-92. The Commission dismissed JAJ and McElroy's applications. In 1991, the Commission granted Phoenix's major modification application. JAJ and McElroy appealed the grant and the dismissals. The court of appeals reinstated JAJ and McElroy's applications. JAJ and McElroy have requested to withdraw their unserved area applications and all pleadings relating to Phoenix's applications. The Commission has reviewed the Petition to Deny and related pleadings and finds that they raise no substantial or material questions of fact under U.S.C. Section 309. The withdrawal and the declarations of all parties have been reviewed according to Section 22.129 of the Commission's rules, 47 C.F.R. Section 22.129.
