section 254(h) or serve the public interest and that there is no
evidence in the record that Abington engaged in activity intended
to defraud or abuse the E-rate program. Accordingly, the Bureau waives
the technology plan rules to the extent provided in the Order and
remands the underlying application to USAC for further consideration
