FREEDOM OF INFORMATION ACT REQUEST
FOR
CABLE TELEVISION PRICE SURVEY DATA
The Media Bureau has received the attached request under the Freedom of Information Act(FOIA), 5 U.S.C. § 552, for certain data submitted to the Federal Communications Commission in
connection with the annual cable television price surveys for the years 1998, 1999, 2000, 2001, 2002,
2004, 2006, 2008, 2009, 2010, 2011 and 2012. The data were collected by the Cable Services or Media
Bureaus as authorized by Section 623(k) of the Communications Act, 47 U.S.C. §543(k).
The Commission has received a number of requests for confidential treatment pursuant to
Sections 0.457(d) and 0.459(d) of the Commission’s rules, 47 C.F.R. §§ 0.457(d), 0.459(d), from survey
participants at the time that they submitted the data. These requests are pending. Accordingly, consistent
with Section 0.461 of the Commission’s rules, 47 C.F.R. §0.461(d)(3), cable television system operators
that participated in the surveys listed above are provided the opportunity to respond to the FOIA request
within ten calendar days from the date of release of this Public Notice. The response should be sent by
e-mail to Sima Chowdhury (sima.chowdhury@fcc.gov) in the Office of Communications and Industry
Information, with a copy to Michael Perko (michael.perko@fcc.gov). A copy also must be provided to
the FOIA requester (yurukoglu_ali@gsb.stanford.edu).
Survey participants who believe that the requested data contains proprietary and commercially
sensitive information which should be withheld from public disclosure must include in their response a
showing that meets the requirements of Sections 0.457(d) and 0.459(d). The FOIA requester will have
ten calendar days from the date of receipt of a response to file a reply with the Commission.
