VIA CERTIFIED MAIL - RETURN RECEIPT REQUESTED
July 10, 2007
John C. Kimbrough
597 Foxfire Court
Murfreesboro, TN 37129
SUBJECT: NOTIFICATION OF REMOVAL OF AUTOMATIC CONTROL PRIVILEGES WR3S
REPEATER OPERATION
Case #EB-2007-3018
Dear Mr. Kimbrough:
Section 97.109(d) of the Commission's rules, 47 C.F.R. S: 97.109(d),
provides that when an Amateur station is being automatically controlled,
the control operator need not be at the control point. The rule also
states that automatic control must cease upon notification by an EIC
(Engineer in Charge, now District Director) that the station is
transmitting improperly or causing harmful interference to other stations;
and that automatic control must not be resumed without prior approval of
the EIC/District Director.
Your Amateur station WR3S is under review by the Enforcement Bureau for
apparent violations of the Commission's rules, including inadequate
station control, interference and failure to properly identify. This
review is the subject of correspondence between you and the Enforcement
Bureau.
You are hereby notified that, until this matter is resolved, WR3S may not
be operated under automatic control. This means that you must be the
active control operator on duty at all times the repeater is operational.
In the event that you are unable to act as the control operator, the
repeater must be shut down.
Automatic control may not resume until you are so notified by this office.
If WR3S is operated under automatic control prior to notification from
this office, enforcement action will be taken against your Amateur
operator and station licenses for WR3S. This action may include
designation of those licenses for a revocation and suspension hearing, and
a monetary forfeiture.
This order is effective upon receipt.
Sincerely,
Douglas G. Miller
