Dear Mr. Nichols:
On February 28, 2008, we notified you that information before the
Enforcement Bureau indicated that in September 2004 and on various dates
since October 2007 you operated on frequencies assigned to Extra Class
licensees but prohibited to General Class licensees. Commission records
show that you are a General Class licensee.
We requested information from you pursuant to Section 308(b) of the
Communications Act of 1934, as amended, 47 U.S.C. S: 308(b), which gives
the Commission the authority to obtain information from applicants and
licensees about the operation of their station and their qualifications to
remain a licensee. You responded by letter received March 18, 2008.
Your March 18, 2008 reply conceded an instance in which you operated in
the Extra Class portion of the band and gave numerous reasons and comments
on the Morse Code exam, Amateur Radio in general, the Extra Class
examination and other radio and kit building topics not relevant to your
out of band operation.
Please be advised that any additional incidents of out-of-band operation
may lead to revocation of your license or a monetary forfeiture, and no
renewal or upgrade application would be granted until such matter is
resolved.
