Re: EB-09-GB-0249
Dear Mr. Bevis:
On April 18, 2006, the Federal Communications Commission notified you that
it had received complaints from (name withheld) that your electric fence
might be causing harmful radio interference to his amateur radio
equipment. (Name withheld)'s contact information is as follows:
(Name withheld)
(Address withheld)
Marstons Mills, MA 02648
Tel: (Number withheld)
The April 18, 2006 letter advised you that the interference, if
unresolved, could be a violation of Commission rules. For this reason, we
encouraged you to voluntarily resolve the matter without Commission
intervention. The letter specifically stated, however, that if it became
necessary for the Commission to facilitate a resolution, the Commission
might investigate possible rule violations and address appropriate
remedies, including monetary forfeitures. Commission records indicate that
you spoke with my predecessor, Riley Hollingsworth, regarding the matter.
During the course of that conversation, it was agreed that when the
interference occurred, (name withheld) would contact you and you would
either clear the weeds or shut down the fence until you could locate and
resolve the interference. (Name withheld) reports that the interference
has begun again and he has called you several times without a response.
Pursuant to your agreement with the Commission, this letter serves to
notify you that you must take the steps necessary to either resolve the
interference or shut off the fence.
In order to avoid enforcement action on this matter, you have thirty (30)
days from the date of receipt of this warning to respond to this office at
the following address: 1270 Fairfield Road, Gettysburg, PA 17325. The
response must contain a statement of the specific action(s) you have taken
to eliminate the source(s) of (name withheld)'s radio interference. If you
have any questions about this matter, please contact me at 717-338-2577.
Sincerely,
Laura L. Smith, Esq.
