On November 15, 2012, Clearwire Corporation (“Clearwire”) filed a series of applications
seeking Commission consent to the
pro forma transfer of control of the licensees controlled by Clearwire
in connection with the sale of Eagle River Investment, LLC’s interest in Clearwire to Sprint Nextel
Corporation.1 On December 14, 2012, the Commission granted the applications. Crest Financial Limited
and DISH Network L.L.C. filed petitions for reconsideration of the processing of these applications as
pro
forma.2 The purpose of this public notice is to announce that these Clearwire applications and related
pleadings are now governed by permit-but-disclose
ex parte procedures that are applicable to non-
restricted proceedings under section 1.1206 of the Commission’s rules.3
Pursuant to section 1.1200(a) of the Commission’s rules,4 the Commission may adopt modified or
more stringent
ex parte procedures in particular proceedings if the public interest so requires. Parties
making oral
ex parte presentations are directed to the Commission’s revised
ex parte rules. Parties are
reminded that memoranda summarizing the presentation must contain the presentation’s substance and
not merely list the subjects discussed.5 More than a one- or two-sentence description of the views and
arguments presented is generally required.6 Other rules pertaining to oral and written presentations are set
forth in section 1.1206(b).7
A copy of each
ex parte notification, which should include a reference to ULS File No.
0005480932, should be submitted through the Commission’s Universal Licensing System as an attachment
to ULS File No. 0005480932. In addition, one copy of each
ex parte submission must be delivered
