The LNPA Selection Working Group hosted a conference call on Wednesday, January 22, 1997, between 2:00 - 3:00 p.m. to discuss the status of the provisioning flow issue escalated to the Working Group by the LNPA Technical & Operational Requirements (T&O) Task Force. Participating on the conference call from the Working Group were:

The T&O Task Force Co-Chairs described the compromise provisioning flows adopted by their team on January 20, 1997, which are outlined in greater detail in the minutes of that meeting. Following are the major three (3) points of the compromise:

1. No due date will be earlier than three (3) business days from the day the Firm Order Commitment (FOC) is generated by the old Service Provider (SP). This represents a compromise by the CLECs as this process allows for an additional day in the flow to resolve issues.

2. The Number Portability Administration Center/Service Management System (NPAC/SMS) processing timers will include business hours only. This was not previously defined.

3. An old SP may cause a port to be placed into conflict following certain timing parameters, however, the new SP, also following certain timing parameters, has the unilateral right to remove a port from conflict. This is a compromise to the ILECs as they had sought additional control over the process.

In addition, the compromise includes putting the following controls into place:

The T&O Task Force will develop a policy statement prohibiting the porting of vacant numbers. The team will recommend adoption of this policy to NANC for FCC concurrence.

The T&O Task Force will also recommend adoption of a plan to resolve instance of SP non-compliance with the policy prohibiting porting vacant numbers. The Task Force will recommend adoption of the process to NANC for FCC concurrence.

A tracking vehicle will be put in place to measure the reasons transactions are placed into conflict in order to identify problems and to develop process improvement plans.

A vote of the Working Group members participating on the call was taken and the vote was unanimous in favor of the compromise. See attached for the details.

On January 23, Woody Kerkeslager and Terry Appenzeller will contact Alan Hasselwander, NANC Chairman, to inform him of the status of this issue. Also, as requested by NANC, Woody Kerkeslanger will present a report at the NANC meeting on January 28, 1997.

* While Pacific Bell voted yes, they do not agree with a process that does not allow the prevention of porting of vacant telephone numbers or telephone numbers that do not have an associated LSR and FOC. Pacific Bell recognizes the need to move forward with these process flows with the condition that NANC recommend that porting of vacant numbers is prohibited until a commission approved process for number pooling is in place. Pacific Bell reserves the right to appeal to the commission on this issue.
