Consumer Protection Rulemaking

The Policy Division of the Consumer & Governmental Affairs Bureau is responsible for several consumer protection rulemakings formerly handled by the Accounting Policy Division, specifically the truth in billing (CC Docket 98-170) and slamming (CC Docket 94-129) rulemakings. The Division is responsible for petitions for reconsideration in those dockets, the pending Further NPRMs in those dockets, and generally any inquiries as to what those rules require. The Division also is responsible for waivers of those rules, including the rules which prohibit carriers from changing a consumer's preferred carrier without the consumer's express authorization. Such waiver requests often arise in situations where carriers seek to discontinue service or seek to merge with another company, and may initially be raised in pleadings that are directed to other divisions, such as Telecommunications Access Policy.
