Report No. CS 97-18 CABLE SERVICES ACTION May 16, 1997 COMMISSION APPROVES ORDER AFFIRMING CABLE SERVICES BUREAU ACTION ON MFS OPEN VIDEO SYSTEM APPLICATION The Commission has approved an order (FCC 97-169) denying a Petition for Reconsideration of the Cable Services Bureau order regarding Metropolitan Fiber Systems of New York, Inc. d/b/a MFS Telecom of New York and Metropolitan Fiber Systems/McCourt, Inc. ("MFS"). The order affirms the Cable Services Bureau's February 27, 1997 order denying MFS' November 5, 1996 Election of Open Video System Option and Motion of Extension of Time to complete Open Video System Transition. In its order, the Commission upheld the Bureau's conclusions that because MFS failed to satisfy the requirements of video dialtone service, it's system was not a video dialtone system.
