Report No. CS 98-4 CABLE SERVICES ACTION March 25, 1998 COMMISSION ACCEPTS FOR COMMENT A PROPOSED RESOLUTION OF CABLE RATE COMPLAINTS INVOLVING CABLEVISION SYSTEMS CORPORATION The Commission has accepted for comment a proposed resolution of cable rate complaints involving Cablevision Systems Corporation ("Cablevision") that, if finally adopted by the Commission, will resolve matters relating to 186 rate complaints filed between September 1, 1993 and May 14, 1994 and 92 complaints filed between May 15, 1994 and August 1, 1997 in 127 franchise areas. These cases involve approximately 1,160,000 current cable programming service subscribers. Key elements of the proposed resolution include:  Cablevision will pay $1.210 million in total refunds to approximately 298,000 subscribers in 59 franchise areas. These refunds include interest and have been calculated through April 30, 1998. If refunds are not made during the May 1998 billing cycle, Cablevision will adjust the refunds to include additional interest.  For most franchises, the Commission will find that Cablevision's rates in effect on August 1, 1997 that were computed by the Commission's benchmark and price cap methodology comply with federal regulations. For three franchises, the Commission will establish August 1, 1997 maximum permitted cable programming service tier rates that are lower than the actual rates in effect on that date and will be used for computing subsequent rate adjustments. For a few franchises, the Commission will find that the rates in effect earlier in 1997 comply with federal regulations. Rates based on 1997 cost-of-service showings are not included in the proposal, and 1998 rate adjustments are not included.  This action does not constitute an admission by Cablevision of any violation of, or failure to conform to, any law, rule, or policy. Interested parties may file comments on the Proposed Resolution by April 24, 1998 and reply comments by May 11, 1998.
