RCN Telecom Services of Massachusetts, Inc., formerly known as Residential Communications Network of Massachusetts, Inc. ("RCN") moves to withdraw its Petition for Partial Reconsideration and Request for Expedited Decision (the "Petition") of Interface Communications Group, Inc., Digital Broadband Applications Corp. and Residential Communications Network of Massachusetts, Inc. v. Cablevision Systems Corp., Rainbow Programming Holdings, Inc. and American Movie Classics Company, CSR-4648-P, 4795-P, 4721-P, DA 96-1520 (rel. Sept. 13, 1996) and requests that its Petition be dismissed with prejudice. As grounds for its motion to withdraw, RCN states that it has been afforded access to the programming that was at issue in this proceeding. 2. The Commission encourages resolution of program access disputes through negotiations between the parties in an effort to avoid time-consuming, complex adjudication. Such a policy favoring private settlement and alternative dispute resolution conserves Commission resources and is thus in the public interest. 3. Accordingly, IT IS ORDERED that the Petition of RCN Telecom Services of Massachusetts, Inc. IS DISMISSED WITH PREJUDICE.
