Arkansas Cable Television Assoc.,) ) Complainants ) ) v. ) PA 97-005 ) Entergy Services, Inc. ) ) Respondent. ) ORDER Adopted: September 15, 1997 Released: September 17, 1997 By the Chief, Cable Services Bureau: 1. In this Order, we address a Joint Motion for Stay of Filing Deadlines filed by Texas Cable and Telecommunications Association, Mississippi Cable Telecommunications Association, and Arkansas Cable Television Association ("Complainants") and Entergy Services, Inc. ("Respondent") on August 21, 1997. By their respective counsel, the parties jointly request that the filing deadlines in the above-captioned case be stayed thirty (30) days, until September 22, 1997 to allow the parties to attempt to settle the Complaint and negotiate a new pole attachment agreement template. Counsel for the parties have met to discuss settlement issues and believe that a settlement in this case would eliminate the need for the filing of further pleadings. As discussed below, we grant the Motion. 2. The Commission has encouraged the use of negotiation in the pole attachment context. Because both parties have agreed, and because no harm results to the public or any other party from such a stay, we find that the equities justify granting a stay of the filing deadlines. We accordingly grant the request for stay of filing deadlines in the above-captioned case. 3. Accordingly, IT IS ORDERED, pursuant to Sections 1.43 of the Commission's rules, 47 C.F.R. Section 1.43, that the Joint Motion For Stay of Filing Deadlines filed by the parties referenced above IS GRANTED. 4. IT IS FURTHER ORDERED, that the filing deadlines in the above referenced case are stayed for thirty (30) days, until September 22, 1997. 5. This action is taken pursuant to delegated authority under Section 0.321of the Commission's rules, 47 C.F.R. Section 0.321. FEDERAL COMMUNICATIONS COMMISSION Meredith J. Jones Chief, Cable Services Bureau
