Falcon Cable Systems Company ("Falcon"), filed with the Commission an appeal of a local rate order issued on May 6, 1997 by the Board of Supervisors of the County of San Luis Obispo, California. This rate order dealt with a number of issues which had been remanded by the Cable Services Bureau in an appeal from an earlier rate order the County adopted on June 20, 1995. 2. On September 29, 1997, Falcon filed a motion to withdraw its appeal. In its motion, Falcon states that it and the Board of Supervisors have resolved certain installation calculations and the amount of the hourly service charge. Consequently, Falcon requests that the Commission dismiss its appeal. 3. Accordingly, IT IS ORDERED THAT Falcon Cable Systems Company's Appeal of the local rate order of the County of San Luis Obispo, California is DISMISSED. 4. This action is taken by the Chief, Consumer Protection and Competition Division, Cable Services Bureau, pursuant to authority delegated by section 0.321 of the Commission's rules, 47 C.F.R.  0.321.
