Section 543(c) (1996). authorizes the Federal Communications Commission  x("Commission") to review the CPST rates of cable systems not subject to effective competition to ensure  xjthat rates charged are not unreasonable. Any incurred cost  S- xthat is not projected may be accrued with interest and added to rates at a later time.f 0 * {Oh-Ѝ See Thirteenth Reconsideration Order at 392.f If actual and  xprojected costs are different during the rate year a "trueup" mechanism is available to correct estimated  SH -costs with actual cost changes.3 H * {O-ԍ Id.3  S - ` x4.` ` On September 4, 1997, the local franchising authority ("LFA") filed its complaint against  S - xOperator's June 1, 1997 CPST rate increase. T * yO-ԍ The first subscriber complaint concerning the CPST rate increase was received by the LFA on June 4, 1997. In its complaint, the LFA asserts that it has received more  xthan one subscriber complaint against Operator's CPST rate increase, thereby triggering the Commission's  x.jurisdiction to review this complaint. The valid complaint from the LFA triggers an obligation on behalf  SX- xyof the cable operator to file a justification of its CPST rates with the LFA.C X* yO-ԍ 47 C.F.R Section 76.1402.C Thus, in this case, Operator  xis required to justify the increase in its CPST rate which is the subject of the LFA's complaint. As  xrequired by our rules, Operator filed FCC Forms 1240 with the LFA as justification for this rate increase. x  S- ` x5.` ` On February 23, 1996, the Commission granted Operator a waiver of certain rate  x=adjustment requirements in its initial filing of the Commission's annual rate adjustment form (FCC Form  Sh- x1240) ("Waiver Order").ht* {O|%- xԍ See Annual Rate Adjustment System for Cable Service Rates, Request for Waiver of Requirements Contained in the Thirteenth Order on Reconsideration, (DA 96220, released February 22, 1996). Specifically, the Waiver Order allowed Operator, in its initial FCC Form 1240  xfilings, to include estimated changes in costs, inflation, channels and subscriber information attributable"@,p(p(88"  xto the period between the last date for which actual cost data was available and the effective date of the  xnew rates. In the Waiver Order, Operator was instructed to include in its initial FCC Form 1240 filing  xcertain calculations, such calculations to be performed on FCC Form 1240 (primarily in Module G), or  xoff FCC Form 1240, in an alternative showing done pursuant to the Waiver Order's "General  S`- x=Guidelines."E`* yO-ԍ Waiver Order at Appendix A.E Operator chose to use an alternative showing rather than perform its calculations directly on FCC Form 1240.  S- ` x6.` ` To justify its CPST rate, effective June 1, 1997, Operator submitted two FCC Forms 1240.  xUpon review of Operator's FCC Forms 1240, we are unable to determine if Operator correctly adjusted  xits second FCC Form 1240 to take into account the calculations performed in its initial FCC Form 1240's  x{alternative showing. We will therefore order Operator to refile its FCC Forms 1240 along with an  xkexplanation detailing why its forms justify Operator's current CPST rate of $16.82 in the community referenced above.
