On December 18, 1996, Chronicle Cablevision of Hawaii, ("Chronicle"), filed with the Commission an appeal of four local rate orders issued by the Department of Commerce and Consumer Affairs of the State of Hawaii ("DCCA") on November 15, 1996. The rate orders directed Chronicle to lower basic cable service rates and refund overcharges to subscribers. On January 17, 1997 the DCCA filed a conditional opposition to the appeal and a motion to dismiss Chronicle's appeal as late filed. The Bureau concluded that Chronicle had failed to file its appeal within the thirty-day deadline required by Commission regulations. The Bureau's Order issued on April 2, 1997 dismissed as untimely Chronicle's appeal of the four local rate orders. On May 2, 1997, Chronicle filed a Petition for Reconsideration, asking the Bureau to reverse its Order. 2. On January 27, 1998 Chronicle filed a motion to withdraw the petition for reconsideration. In its motion, Chronicle states that the parties have reached a final resolution of their dispute concerning BST rates and refunds and that further Commission action regarding this matter is no longer necessary. 3. Accordingly, IT IS ORDERED that the Motion to Withdraw filed by Chronicle Cablevision IS GRANTED, and the Petition for Reconsideration IS DISMISSED. 4. This action is taken by the Chief, Consumer Protection and Competition Division, Cable Services Bureau, pursuant to authority delegated by section 0.321 of the Commission's rules. 47 C.F.R  0.321 (1993).
