It contends that from the beginning, WHCTTV not only was aware of  xComcast's carriage denial on the Groton System, but understood that Comcast did not intend to carry the  x[Station on that system because of signal strength deficiencies; first, when Comcast effectively denied the  xkMarch 7 and April 4, 1997 carriage requests, and again, on May 5, 1997, when Comcast reiterated its  xrefusal of carriage. Comcast states that WHCTTV's lack of good faith allegations are an attempt to  xblame Comcast for the Station's own delays, and asserts that WHCTTV's arguments about Comcast's  SH -"supposed intentions" are speculative.7H [ {O-ԍId. at 6.7  S - ` nx8.` ` Comcast points out that the fact that it "is carrying the [WHCTTV] signal on its systems  xserving New Haven, Middletown and Clinton, undermines WHCT's claim that Comcast engaged in an  xelaborate plot to `mislead' WHCT in order to `delay carriage or to deprive WHCT of its procedural rights,'  S - xlwith respect to this one system."1 h [ {O-ԍId.1 Finally, Comcast contends that WHCTTV misinterprets the  SX- xCommission's rules when it claims that the Station "had absolutely no basis under the rules for filing a  S2- xcomplaint with the Commission until it had improved its signal quality and became eligible for carriage."I2 [ {O-ԍId. at 7 and Petition at 6.I  xComcast notes that a station does not have to "become eligible for carriage" before the Commission will  x!grant a mustcarry complaint. Comcast points out that "the Commission has granted must carry  S- xcomplaints on the basis of stations' commitments to deliver an adequate signal to the cable headend"L [ yO-ԍOpposition at 7 (citations omitted).L  xThus, according to Comcast, since "WHCT had made a commitment to deliver a good quality signal to  xComcast's headend in its March 7, request for carriage," WHCT had "sufficient basis upon which to file a must carry complaint within the required period of time."  S- ` 2x9.` ` In reply, WHCTTV restates its earlier arguments and asserts that "circumstances in this  S- xcase are unique" because the Station had recently returned to the air; the future of the mustcarry rules  x/was uncertain and in the hands of the Supreme Court; and its management "was acutely aware of the  x>perceived uncertainties." As a result, WHCTTV argues, the Station "felt in no position to `demand'"z,`(`(88"  S- xcarriage under the Commission's must carry rules."3[ yOh-ԍReply at 2.3 Hence, WHCTTV asserts, the March 7, 1997 letter could not have been a mustcarry request.  S- IV.xDISCUSSION  S8- ` x 10.` ` The petition claims error in the Bureau's conclusion that the March 7, 1997 letter  xzconstituted a mustcarry request for the carriage of WHCTTV's signal on Comcast's Groton System.  xWHCTTV claims that the March 7, 1997 letter and other correspondence between the parties show that,  xrather than demanding carriage, WHCTTV was notifying Comcast of the Station's mustcarry election  xyover retransmission consent. WHCTTV contends that it did not formally demand mustcarry treatment  xuntil it had attained adequate signal strength and formally requested mustcarry treatment, which was not  xaccomplished until WHCTTV's October 3, 1997 letter to Comcast. We are not persuaded by this  xargument. The language used in the March 7, 1997 letter constituted a clear request for mandatory  S - xkcarriage. As noted in the Order, in its April 4, 1997 letter, WHCTTV referred to the March 7, 1997  S - xLcorrespondence as the letter in which it "invoked its statutory right to mustcarry."I X[ {O-ԍOrder, 13 FCC Rcd at 9432..I Similar language is  S -also used in WHCTTV's May 19, 1997 letter to Comcast.z [ yO4- xԍThe first paragraph of that letter reads: Thank you for your certified letter, dated May 5, 1997. Your letter  xresponds to my March 7, 1997, letter to Comcast Cablevision of Groton, Inc. ("Groton system"), Comcast  xLCablevision of Clinton, Inc. ("Clinton system"), and Comcast Cablevision of Middletown, Inc. ("Middletown  xKsystem"), in which letter WHCT invoked its statutory right to "Must Carry" protection on these three Comcast systems pursuant to Sections 4 and 5 of the Consumer Protection and Competition Act of 1992.z  SZ- ` ~x 11.` ` WHCTTV argues that it was not required to exercise its mustcarry rights until after it  x/became eligible for carriage through the provision of an adequate signal strength to Comcast's Groton  xsystem headend. Therefore, WHCTTV asserts that its complaint, filed on December 29, 1997 was timely  x.filed. WHCTTV's argument is not supported by the Commission's regulations or precedent. As noted  xLby Comcast, the Commission has routinely granted mustcarry complaints even when a station does not  xjprovide a good quality signal but has committed to delivering a good quality signal to the cable operator's  Sj-headend.j[ {O- xԍSee e.g. Paxson Communications Corporation, 13 FCC Rcd 12762 (1998); SAH Acquisition Corporation II,  {On-13 FCC Rcd 16334 (1998); and Channel 44 of Tulsa, 13 FCC Rcd 7136 (1998).  S- ` Ax 12.` ` WHCTTV argues that the Bureau erred because it did not take into consideration the fact  xthat Comcast did not raise the issue of timeliness in connection with the carriage of the WHCTTV signal  x\on the Middletown and Clinton systems, which, according to WHCTTV, Comcast began to carry in  xDecember 1997. The Bureau did not take into account the timeliness factor in those two systems because  xit was not raised in WHCTTV's initial complaint. Nor is it appropriate that we consider that information  SR- xfor the first time on reconsideration.JR [ {O%-ԍSee 47 C.F.R.  1.106(c).J Moreover, the fact that Comcast elected to carry WHCTTV's  x<signal on its Middletown and Clinton systems despite the fact that WHCTTV's statutory mustcarry right"* ,`(`(88"  xhad expired is not relevant to our determination in this proceeding. In this regard, we note that Comcast's  xMay 5, 1997 letter to WHCTTV clearly indicated that the Station's signal on the Middletown system was  xacceptable and that the cable operator had plans to add WHCTTV to that system on January 1, 1998.  xAccordingly, we find that WHCTTV has raised no new arguments indicating that it is entitled to must x/carry treatment on Comcast's Groton, Connecticut cable system, or otherwise persuaded us that our underlying decision was in error.
