No. 1 ) ORDER Adopted: October 14, 1997 Released: October 14, 1997 By the Chief, Competitive Pricing Division, Common Carrier Bureau: 1. On October 8, 1997, Bell Atlantic Telephone Companies (Bell Atlantic) filed Transmittal No. 1004, which proposes to revise rates for certain unbundled payphone features made available under its federal access tariff, and which is scheduled to become effective on October 15, 1997. On October 10, 1997, the American Public Communications Council (APCC) filed comments in response to Transmittal No. 1004. 2. The rates and services proposed in Transmittal No. 1004 fall within the scope of issues that are under investigation in CC Docket No. 97-140, the Commission's investigation of local exchange carriers' payphone functions and features tariffs filed at the federal level. That investigation includes Bell Atlantic Transmittal Nos. 962 and 966. Therefore, Transmittal No. 1004 will be suspended for one day and will be subject to the investigation initiated in CC Docket No. 97-140. The Common Carrier Bureau designated the issues set for investigation in the LEC Designation Order. Any rates proposed in this transmittal will be subject to the accounting order imposed in CC Docket No. 97-140 in order to facilitate any refunds that may later prove necessary. 3. Accordingly, IT IS ORDERED that, pursuant to Section 204(a) of the Communications Act of 1934, as amended, 47 U.S.C.  204(a), and Section 0.291 of the Commission's Rules, 47 C.F.R.  0.291, the revisions to Bell Atlantic Telephone Companies Tariff F.C.C. No. 1, Transmittal No. 1004 ARE SUSPENDED for one day from the effective date and an investigation of the referenced tariff transmittal IS INSTITUTED. 4. IT IS FURTHER ORDERED that, Bell Atlantic Telephone Companies SHALL FILE tariff revisions within five business days of the release date of this Order to reflect this suspension. 5. IT IS FURTHER ORDERED that, for the above purposes, we waive Sections 61.56, 61.58, and 61.59 of the Commission's Rules, 47 C.F.R.  61.56, 61.58, and 61.59. Bell Atlantic Telephone Companies should cite the "DA" number of the instant Order as the authority for this filing. 6. IT IS FURTHER ORDERED that, pursuant to Section 204(a) of the Communications Act of 1934, as amended, 47 U.S.C.  204(a), Bell Atlantic Telephone Operating Companies shall keep accurate account of all amounts received by reason of the rates that are the subject of this investigation.
