INTRODUCTION   X4\1.` ` We have before us a petition for reconsideration by complainant Keith Maydak (Maydak) in the abovecaptioned proceeding. Maydak seeks reconsideration of the Bureau's Memorandum Opinion and Order denying his formal complaint against AT&T  X4Communications (AT&T).Qpm {O '#C\  P6QrP##C\  P6QrP#эIn the Matter of Keith Maydak v. Bur. 1998) ( Maydak Order).q (#Q For the reasons stated below, we deny the petition.  $pm yOg '#C\  P6QrP#эSection 1.106(a)(1) of the Commission's rules, 47 C.F.R.  1.106(a)(1), gives the Common Carrier Bureau (Bureau) the option either to rule on a petition for reconsideration of an action taken under delegated authority or to refer the petition to the Commission for resolution. We have opted to rule on the petition because it does not raise any new or novel question of law requiring the Commission's direct participation. X01Í ÍX01Í Í  Xd4#7 II. BACKGROUND ă  X642.` ` In his formal complaint, Maydak sought a Commission order declaring that"6 0*''" AT&T, an interexchange carrier, had improperly charged him for a call that should not have  X4generated a toll record.`Z; {Ob'#C\  P6QrP#эMaydak Order, 13 FCC Rcd at 2240. He claims that the number to which he was charged for a completed call (5124729941) is an AT&T test line that does not have answer supervision that would trigger a billing record when the called number answers. ` Maydak thus contended that AT&T had violated its tariffs and  X4section 203 of the Communications Act of 1934, as amended (the Act),u; yOm'#C\  P6QrP#э47 U.S.C.  203.u because its tariffs do  X4not permit it to bill for unmade or uncompleted calls.z; {O '#C\  P6QrP#э  Maydak Order, 13 FCC Rcd at 2240 .   X43.` ` The Bureau dismissed Maydak's complaint finding that Maydak had failed to meet the threshold burden of proof imposed on complainants by our rules promulgated under  X_4section 208 of the Act._ ; {O'#C\  P6QrP#эMaydak Order, 13 FCC Rcd at 2242. See, e.g., Directel Inc. v. AT&T, 11 FCC Rcd 7554, 756061  {O'(1996); Amendment of Rules Concerning Procedures to be Followed when Formal Complaints Are Filed Against  {O'Common Carriers, 8 FCC Rcd 2614, 261617 (1993); Connecticut Office of Consumer Counsel v. AT&T  {Oz'Communications, 4 FCC Rcd 8130, 8133 (1989), aff'd. sub nom. Connecticut Office of Consumer Counsel v.  {OD'FCC, 915 F.2d 75 (2d Cir. 1990), cert. denied, 499 U.S. 920 (1991). Under the Commission's formal complaint requirements, complaints against common carriers must contain a complete statement of facts which, if true, are  X14sufficient to constitute a violation of the Act, Commission rule, or order.1 ; {O'#C\  P6QrP#эXSee 47 C.F.R.  1.720(b), (c) (1997).(#Ǝ Under these  X 4requirements, facts must be supported by affidavit or other relevant documentation. X ; yO#'#C\  P6QrP#эX47 C.F.R.  1.721(a)(5) (1997).(#ƈ The Bureau held that Maydak's complaint failed to provide affidavits or other relevant documentation that would support his primary contention that calls to the number in question  X 4are not generally billed by AT&T. ; {On'#C\  P6QrP#эX#C\  P6QrP#Maydak Order, 13 FCC Rcd at 2243.#C\  P6QrP#(# The Bureau stated that, even though Maydak had sufficient opportunity to provide or obtain such evidence during the proceeding, Maydak had  X 4submitted no supporting evidence. z; {O'#C\  P6QrP#эX#C\  P6QrP#Id.#C\  P6QrP#(#Ʒ The Bureau further held that Maydak had provided no  X4support for his claim that AT&T had billed him in an effort to harass him.i  ; {OM"'#C\  P6QrP#эXId.(#i The Bureau also denied Maydak's motion to compel AT&T to answer his interrogatories on the ground that Maydak's motion was untimely filed. Finally, the Bureau stated that it did not have to address Maydak's request for relief because of his failure to demonstrate a violation of the"K 0*8&8&" Act. It did note, however, that forfeitures are not available as a remedy to a complainant in a  X4formal complaint proceeding. hhC  X4  III. PETITION FOR RECONSIDERATION   X4\4.` ` In his petition, Maydak contends that the Bureau's decision to deny his complaint on the basis of insufficient probative evidence without first having ruled on the  X_4motion to compel was arbitrary and capricious.n _; yO'#C\  P6QrP#эXPetition at 1.(#n Maydak claims that it was necessary for him to have had a ruling first on the motion to compel in order to know how to proceed in  X14supporting his contentions. 1X; yO: '#C\  P6QrP#эX#C\  P6QrP#Petition at 2.#C\  P6QrP#(#Ƽ According to Maydak, had the Commission made an interlocutory ruling on his motion to compel, he would have had the opportunity to timely file  X 4the required support.i ; {O'#C\  P6QrP#эXId.(#i He argues that common sense dictates that a party would wait until a ruling on discovery before making its presentation, inasmuch as the evidence submitted would  X 4necessarily be contingent on the amount of evidence discoverable.i z; {O'#C\  P6QrP#эXId.(#i Additionally, he contends that the Bureau's decision to dismiss the complaint because of procedural deficiencies was disingenuous in light of the statement contained in the Notice of Formal  X4Complaint that the complaint met the procedural requirements of the rules.i ; {OM'#C\  P6QrP#эXId.(#i Maydak also contends that the Bureau erred when it stated that a forfeiture was not available as relief in the formal complaint process, because the imposition of a forfeiture is mandatory under the  XK4Act.K; yO'#C\  P6QrP#Ѝ#C\  P6QrP# Petition at 3. Finally, without comment or a motion to accept for consideration, Maydak has appended to the petition a declaration that ostensibly contains the material that the Bureau found lacking in the original record. AT&T did not file a response to the petition.   X4|? IV. DISCUSSION ă  X45.` ` In order to prevail on reconsideration, the Commission's rules require a  X4petitioner to demonstrate that the underlying action was based on errors of fact or law.. ; {O#'#C\  P6QrP#эX47 C.F.R.  1.106(d)#C\  P6QrP#. See, e.g., Application of Aspen FM, 12 FCC Rcd 17852, 17855 (1997).(# Accordingly, the Commission has denied reconsideration if the petition did not raise a" 0*8&8&z"  X4material legal error that would change the ruling made in the order.^; {Oy'#C\  P6QrP#э#C\  P6QrP#See, e.g., Application of Davidson County Broadcasting Co., Inc., 12 FCC Rcd 12245, 1224647 (1997);  {OC'Eagle Radio, 12 FCC Rcd 5105 (1997); Application of Waller Broadcasting, Inc., 11 FCC Rcd 7383, 7384  {O '(1996); FCVS Communications, 9 FCC Rcd 2270 (1994). Maydak has failed to meet this requirement. He has merely alleged, without factual or legal support, that the action taken by the Bureau was arbitrary and capricious. Moreover, petitions for reconsideration are  X4inappropriate for redebating matters that the Commission has already resolved.; {OZ'#C\  P6QrP##C\  P6QrP#э Application of Ponce Television Corp., 2 FCC Rcd 5878, 5880 (1987).   X46.` ` Even if we had made the requested interlocutory ruling on the motion to  Xv4compel, it would have had no bearing on the ultimate denial of the complaint. Maydak incorrectly claims that, had the motion to compel been denied on an interlocutory basis, he would have been able to submit a factual presentation. The Bureau denied Maydak's motion to compel because it was untimely filed. An interlocutory ruling would not have given Maydak the opportunity to reopen the record and cure the shortcomings of his complaint. The record would still have been inadequate, and Maydak would still have not met his threshold burden of persuasion.  X 47.` ` Additionally, Maydak's attempt to utilize his petition for reconsideration to rehabilitate the shortcomings of his complaint, by now providing the allegedly requisite support for his allegations, is inappropriate. Section 1.106(b)(2) of the Commission's rules permits the consideration of latersupplied evidence only if the petitioner can show that this evidence is based on facts that were unavailable or unknown to petitioner until after his last  XK4opportunity to present such material.K; {O|'#C\  P6QrP#э #]\  PCrP#47 C.F.R.  1.106(b)(2). See, e.g., Daniel's Cablevision, Inc., 12 FCC Rcd 17410 (1997) (holding that  yOF'unless the latersupplied information satisfies one of the categories in 1.106(b)(2), it cannot be considered).#o\  PC~XP#ѵ Maydak simply appended this material to his petition without explaining whether the information contained therein was unavailable or unknown to  X4him before the Maydak Order's release. Indeed, Maydak's petition does not even refer to the appended material or seek leave for its belated consideration.  X48.` ` The Act provides for the imposition of a forfeiture only if a violation of the  X4Act has occurred.; {ON '#]\  PCrP#э#]\  PCrP#See 47 U.S.C.  501 et seq.#o\  PC~XP# Because Maydak has failed to demonstrate a violation of the Act, we need not consider Maydak's claim that a forfeiture was an appropriate remedy. We reiterate, however, that imposition of a forfeiture is not available as a remedy to a complainant in a formal complaint proceeding. Section 208 provides for private remedies for individuals aggrieved by carriers, while Section 503 gives the Commission the discretion to assess"gl 0*8&8&"  X4forfeitures.; yOy'#]\  PCrP#э47 U.S.C.  208, 503((b); 47 C.F.R.  1.80(e). Thus, the Commission may, on its own motion, pursuant to section 1.80 of our rules, assess a forfeiture against any person found to have willfully or repeatedly violated any  X4provision of the Act or any Commission rule, regulation, or order.lX; yO'#]\  PCrP#э47 C.F.R.  1.80.l  X49.` ` Finally, there is no inconsistency between the statement in the Notice of Formal Complaint that the complaint met the procedural rules for service and the Bureau's finding that complainant had not met his burden of persuasion. The former is simply a statement that the complaint superficially meets the procedural rules for the purpose of service. It does not connote completeness nor supersede the underlying substantive burden of persuasion imposed on the complainant by the Commission's rules. Again, Maydak merely has an unsupported allegation rather than a reasoned argument. Therefore, the Bureau's ruling on this point has not been shown to have been arbitrary or capricious.  X 4j  V. CONCLUSION AND ORDERING CLAUSE   X4\ 10.` ` In his petition for reconsideration, Maydak has once again failed to meet the threshold burden imposed by the Commission's rules. Like his complaint, the petition for reconsideration consists of nothing more than unsupported allegations. Maydak has not demonstrated that our action was arbitrary and capricious and he has failed to convince us that we were in error in denying his complaint for lack of probative evidence.   X4 11.` ` Accordingly, IT IS ORDERED, pursuant to sections 1, 2(b), 4(i), 4(j), and 208 of the Communications Act of 1934, as amended, 47 U.S.C.  151, 152(b), 154(i), 154(j), 208, and pursuant to authority delegated in Sections 0.91 and 0.291 of the rules, 47 C.F.R.  0.91, 0.291, that the petition for reconsideration filed by Keith Maydak in the abovecaptioned matter IS DENIED and this proceeding IS TERMINATED.  ` `  hhCFEDERAL COMMUNICATIONS COMMISSION  X4 hhCLawrence E.
