X 4 e 3.` ` Under the streamlined process developed by the District Court, the BOC submitted  xits waiver request to the Department of Justice (Department). The Department reviewed the  x_request and then submitted the request, along with the Department's recommendation, to the  Xb4 xIDistrict Court. In evaluating ELCS requests, the Department and the District Court considered  XK4 xthe number of customers or access lines involved Kxۿ {Ot#'ԍSee United States v. Western Electric Company, Inc., No. 820192, slip op. at 3 n.8 (D.D.C. July 19,  {O>$'1984) (hereinafter July 1984 Order). as well as whether a sufficiently strong"K ,N(N(ZZQ"  X4 x@community of interest between the exchanges justified granting a waiver of the Consent Decree. ^ۿ {Oy'ԍSee, e.g., United States v. Dec. 17, 1993).  xA community of interest could be demonstrated by such evidence as: (1) poll results showing  xlthat customers in the affected exchange were willing to pay higher rates to be included in an  X4 xexpanded local calling area;Wۿ {OZ'ԍSee July 1984 Order, at 2 n.5. W (2) usage data demonstrating a high level of calling between the  xexchanges; and (3) narrative statements describing how the two exchanges were part of one  xucommunity and how the lack of local calling between the exchanges caused problems for  Xv4 xcommunity residents.Zvۿ {O 'ԍSee Jan. 1985 Order, at 23 & n.3. Z In addition, the Department and the District Court gave deference to the  xstate's community of interest finding. The District Court also considered the competitive effects  XH4of granting a proposed ELCS waiver.Hۿ {O 'ЍSee July 1984 Order; Jan. 1985 Order; United States v. Western Electric Company, Inc., No. 820192,  {O'slip op. at 2 (D.D.C. May 18, 1993) (hereinafter May 1993 Order). The District Court granted waivers for more than a hundred flatrated, nonoptional ELCS plans that allow the provision of traditional local telephone  {Og'service between nearby exchanges. See, e.g., Western Electric, 569 F. Supp. at 1002   n.54; July 1984 Order; Jan.  {O1'1985 Order. Under such plans, subscribers pay no extra charge for calls beyond their established monthly service  yO'charge (the plan involves a flatrated charge), and all subscribers in the exchange are included in the plan (the  {O'plan is nonoptional). Id.Ħ  X 4 e 4.` ` Congress, however, in adopting the 1996 Act, shifted the MFJ Court's exclusive  xauthority over LATA boundaries to the Commission. Section 601(a)(1) and 601(e)(1) of the Act  X 4 x make any conduct or activity formerly subject to the AT&T Consent Decree subject to the Act.V \ ۿ yO'ԍ47 U.S.C.  152(a)(1), (e)(1).V  xAdditionally, section 3(25) of the Act defines a LATA, in part, to mean a "contiguous geographic  X 4 xarea . . . established or modified by a Bell operating company after [February 8, 1996] and  X 4 xapproved by the Commission."Y ۿ yOF'ԍ47 U.S.C.  153(25) (emphasis added).Y The Act thus gives the Commission sole authority to approve  xany BOC action to establish or modify LATA boundaries after February 8, 1996. Nothing  xelsewhere in the text of the Act or in its legislative history restricts the Commission's authority  xto approve LATA modifications except that section 10(d) of the Act prohibits the Commission  xfrom forbearing or taking any action that would forbear from applying the requirements of  X84 xSection 271.G8|ۿ yOe$'ԍ47 U.S.C.  160(d).G The Commission's authority under section 3(25) applies to LATA modification requests in general, and, specifically, to expanded local calling service (ELCS) requests.  X 4   X4 e ,  5.` ` On July 15, 1997, as a result of the 1996 Act, the Commission released a decision" ,N(N(ZZ"  X4 xugranting 23 requests for limited boundary modifications to permit ELCS.iۿ {Oy'ԍJuly 1997 Order, cited supra, n.10. i Although calls  xbetween the ELCS exchanges would now be treated as intraLATA, each ELCS exchange would  X4 xremain assigned to the same LATA for purposes of classifying all other calls. Zۿ yO'ԍIf an exchange were assigned to another LATA for all purposes, any existing local calling routes between that exchange and the original LATA would be lost because such traffic would now be interLATA and could no longer be carried by the BOC. Instead, the traffic would generally be carried by an interexchange carrier charging long distance rates. The Commission  xstated that it would grant requests for such limited modifications only where a petitioning BOC  xshowed that the ELCS was a flatrated, nonoptional service, a significant community of interest  xexisted among the affected exchanges, and grant of the requested waiver would not have any  Xv4 xanticompetitive effects.bvBۿ {Oi 'ԍJuly 1997 Order, 12 FCC Rcd at 10654.b The Commission stated further that a carrier would be deemed to have  x<made a prima facie case supporting grant of the proposed modification if the ELCS petition: (1)  xchas been approved by the state commission; (2) proposes only traditional local service (i.e., flat xcrated, nonoptional ELCS); (3) indicates that the state commission found a sufficient community  xof interest to warrant such service; (4) documents this community of interest through such  xevidence as poll results, usage data, and descriptions of the communities involved; and (5)  X 4involves a limited number of customers or access lines. ۿ {Oq'ԍId. at 10659. In certain situations, the Commission has delegated authority to the Common Carrier  {O;'Bureau to modify LATA boundaries. Id. at 10657. On August 6, 1997, the Commission released a decision granting requests to modify LATA boundaries to permit three independent telephone company (ITC) exchanges in Texas to change LATA association for purposes of improving service to subscribers. The Commission stated that a carrier will be deemed to have made a prima facie case supporting grant of a proposed association change if the petition: (1) states that the association change is necessary because of planned upgrades to the ITC's network or service that will require routing traffic through a different BOC LATA; (2) involves a limited number of access lines; and (3) includes a statement from the affected BOC(s) requesting a LATA modification, pursuant to section 3(25) of the Act, to permit the change in association. Petitions for LATA Association  {O}'Changes by Independent Telephone Companies, Memorandum Opinion and Order, CC Docket No. 96158, 12 FCC Rcd 11769 (1997).  X ' ` `  hhCIII. DISCUSSION  X4 e 6.` ` This present petition is different from prior ELCS requests in that it both presents  xa standard ELCS request and also asks the Commission to modify the LATA boundary for all  x<purposes so that the East Palestine, Pa. customers will be included in the Pittsburgh LATA. In  xdetermining whether it is appropriate to modify the LATA boundary so that the East Palestine,  xPa. customers can be served by Bell Atlantic, however, we apply a twoprong test similar to the  xone that we use in evaluating ELCS requests. First, we determine whether the LATA  x/modification in question will provide a significant public benefit, such as, for example, enhanced  xVpublic safety, revision of anomolous LATA assignments based on network configurations at the  xRtime of divestiture, increased quality in operator and other services, expanded deployment of":,N(N(ZZT"  xservices, or other factors specific to the exchanges affected by the proposed LATA modification.  xSecond, we balance the public benefit, if any, that granting the requested modification may  xprovide against the effect that such a grant would have on a BOC's incentives to fulfill its section  X4 x 271 obligations.ۿ yO4'ԍThe Common Carrier Bureau (Bureau) has employed this test in its review, under delegated authority, of  yO'ELCS LATA modification requests and to approve a petition filed by Southwestern Bell (SBC) to provide ISDN service across a LATA boundary in Hearne, Texas. Southwestern Bell Telephone Company Petition for Limited Modification of LATA Boundaries to Provide Integrated Services Digital Network (ISDN) at Hearne, Texas,  {OT'Memorandum Opinion and Order, 13 FCC Rcd 13166 (Com. Car. Bur. 1998) (Hearne). Among the criteria used to evaluate the public benefit of a proposed modification are: the type of telephone service to be provided; whether there has been approval by the relevant state commission for the expanded local calling area; and whether the state has found that a community of interest exists in the area for which ELCS is sought. Other criteria used are whether the proposed LATA modification would have any impact on the BOC's incentive to file a section 271 application, including the number of customer access lines affected by the LATA, and the type of  {O 'services to be provided. ELCS Order, 12 FCC Rcd at 10653.  We emphasize, however, that under the circumstances that obtain here, we will decide LATA modification requests on a casebycase basis, evaluating the factors listed above.  Xv4 e 7.` ` In the present case, we find that there are public benefits presented by this petition.  xZSince divestiture, East Palestine, Pa. customers have been located in an area that would have been  xserved by Bell Atlantic were it not for the network configuration at the time of divestiture.  x"According to Bell Atlantic, the relocation of East Palestine, Pa. will allow customers to receive  xenhanced 911 (E911) service from their local governmental emergency network. Currently, 911  x_calls must be relayed from Ohio (by an Ameritech operator) into Pennsylvania without E911  x/customer address information being made available to all answering parties. Another benefit is  x<that residential and business customers will be able to choose an optional intraLATA toll calling  xplan for calls to schools and local governmental services as opposed to such calls being interstate  xinterLATA calls. East Palestine, Pa. customers will have access to all current and future  xtelecommunications service choices which are available to other Pennsylvania residents, and will  xbe closer to Bell Atlantic business offices. Finally, operator services will also improve for East  xPalestine, Pa. customers in that local directory assistance will be provided by Bell Atlantic or  xcother carriers in the Pittsburgh LATA; currently, customers often experience delays and redials  xbecause operator services are provided by Ameritech, which does not have information regarding the Pittsburgh LATA.  X4 e 8.` ` In addition to the facts stated above, petitioners: (1) state that the transfer of the  x&East Palestine, Pa. customers from the Youngstown LATA to Pittsburgh LATA would not create  X4 xany new service offerings;7, ۿ yO"'ԍBell Atlantic states that its East Palestine customers will have access "to all applicable Residence and Business Local Calling Usage Options (measured and flat rated local usage options) and toll usage optional plans available to customers located within the Pittsburgh LATA." Ameritech states that the "Ameritech Ohio customers currently have flat rated and measured rated service [sic] local service options to the East Palestine, Pa. exchange from the East Palestine (Ohio), New Waterford and Rogers exchanges."7 (2) provide letters of support for the joint petition from the Public  xUtility Commission of Ohio and Pennsylvania Public Utility Commission stating that no customer",N(N(ZZ"  xor customer services will be adversely affected by this LATA modification request; (3) state that  xno polls were taken, but that Bell Atlantic contacted 5 customers to inform them of the "rehome"  xplan and plans to contact all the customers via a special letter to explain the changes; (4) include  X4 xa statement of the number of access lines involved;HXۿ yO4'ԍEast Palestine, Pa. has 14 residential access lines; 16 business lines. East Palestine, Oh. has 3,114 residential lines; 801 business lines. New Waterford, Oh. has 1,455 residential lines; 169 business lines. Rogers, Oh. has 1,240 residential lines; 119 business lines.H and (5) include a community of interest  xstatement that East Palestine, Pa. was included in an Ohio LATA solely to accommodate the  xynetwork configuration that existed at the time of divestiture and not due to any community of  x}interest concerns. Bell Atlantic has also informed its customers of their new E911 service to be  xprovided by Beaver County, and that the $1.00 per month per line will be charged for E911  xservice. We conclude that the facts presented in the petition show that modifying the LATA  xEboundary to include East Palestine in the Pittsburgh LATA and allowing ELCS between the relevant exchanges will be in the public interest and not have any anticompetitive effects.  X 4 e 99.` ` Additionally, the information submitted in support of the ELCS request shows that  xgranting the LATA modification will not lessen the petitioners' incentives to fulfill their section  X 4 x271 obligations. As we noted in the July 1997 Order, granting an ELCS petition removes the  xproposed route from the competitive interexchange market, and some LATA modifications could  xpreduce the BOCs' incentive to open their own markets to competition pursuant to section 271 of  X{4 xIthe Act.{ۿ {O'ԍSee July 1997 Order, 12 FCC Rcd at 1065354; 47 U.S.C.  271(b)(1). From the perspective of open markets and competition, the LATA modifications we  xapprove today essentially maintain the status quo. Given the small number of access lines and  xthe small volume of traffic involved for the proposed ELCS areas in this petition, it is highly  xunlikely that provision of ELCS service would reduce petitioners' motivation to open their own  xmarket to competition. We find that the proposed LATA modification will not have a significant  xanticompetitive effect on the interexchange market or on petitioners' incentives to open their own markets to competition.  X4  X'` `  hhC VI. CONCLUSION  Xg4 e 10.` ` We conclude that, in this request, the need for the LATA modification and  xproposed ELCS routes outweigh the risk of potential anticompetitive effects. Granting Bell  x Atlantic and Ameritech's petition serves the public interest by permitting a minor LATA  xmodification where such modification is necessary to meet the needs of local subscribers and will  xnot have any significant effect on competition. Accordingly, we approve Bell Atlantic and  xVAmeritech's petition to move East Palestine, Pa. from the Youngstown LATA to the Pittsburgh  xLATA, for all purposes, and allow ELCS between the relevant exchanges. Thus, nonoptional  xVELCS between the specified exchanges will be treated as intraLATA, and the provisions of the" z,N(N(ZZb"  X4Act governing intraLATA service will apply. ۿ {Oy'ԍThe BOC may provide ELCS service without meeting the section 271 requirements, see 47 U.S.C.   {OC'271(a), and a separate affiliate is not required. See 47 U.S.C.  272(a)(2)(B).   X' ` `  hhCVII. ORDERING CLAUSES  X4 e 11.` ` Accordingly, IT IS ORDERED, pursuant to sections 3(25) and 4(i) of the  xCommunications Act of 1934, as amended, 47 U.S.C.  153(25), 154(i), and 47 C.F.R.  0.91  xand 0.291 of the Commission's rules, that the requests of Bell Atlantic and Ameritech for LATA  xpmodification to move the East Palestine, Pa. exchange from the Youngstown, Oh. LATA to the  xPittsburgh, Pa. LATA, and for the limited purpose of providing nonoptional ELCS at the specific locations identified in File No. NSDL98123, ARE APPROVED.
