PUBLIC NOTICE FEDERAL COMMUNICATIONS COMMISSION 1919 M STREET, N.W. WASHINGTON, D.C. 20554 News media information 202/418-0500 Fax-On-Demand 202/418-2830 Internet: http://www.fcc.gov ftp.fcc.gov DA 97-2245 CC Docket No. 97-211 Released: October 24, 1997 EX PARTE COMMUNICATIONS RELATING TO OTHER EFFORTS TO ACQUIRE OR OBTAIN TRANSFER OF CONTROL OF MCI LICENSES AND AUTHORIZATIONS On October 9, 1997, the Common Carrier Bureau issued a public notice that revised the pleading cycle relating to the request of WorldCom Inc. (WorldCom) for Commission grant of Special Temporary Authority (STA) for an interim transfer of stock of MCI Communications Corporation (MCI) to an independent trustee. In that public notice, the Bureau clarified that the WorldCom proceeding, the BT-MCI, and related Primestar proceedings would be treated as interrelated for ex parte purposes. Therefore, any presentation made in any one of these "permit but disclose" proceedings that affects the merits of any of the other interrelated proceedings is subject to appropriate disclosure in accordance with the procedures set forth in Section 1.1206 of the Commission's ex parte rules, 47 C.F.R. 1.1206. In view of recent news and trade reports concerning other efforts to acquire or obtain control of MCI, the public is hereby advised that any ex parte communications made to Commission decision-making personnel about any other efforts to acquire or obtain control of MCI likewise will be considered ex parte presentations that go to the merits or outcome of the WorldCom applications and the other interrelated proceedings. The public is reminded that any such communications are ex parte presentations even though no other applications and/or requests relating to such efforts have yet been filed with the Commission. Therefore, should any such written or oral presentations occur, appropriate disclosure should be made in each of the interrelated proceedings in accordance with the procedures set forth in Section 1.1206 of the ex parte rules. Should a subsequent application be filed that seeks to acquire or obtain control of MCI, it will also be treated for ex parte purposes as a "permit but disclose" proceeding, it will also be treated as interrelated, and appropriate disclosure would need to be made in each of the interrelated proceedings.
