DA 97-2328 COMMISSION SEEKS COMMENT ON MOTION FOR ADMINISTRATIVE STAY OF CENTREX PREEMPTION DECISION FILED BY SOUTHWESTERN BELL TELEPHONE COMPANY CCBPol 96-13, 14, 16 and 19 Released: November 5, 1997 On October 31, 1997, Southwestern Bell Telephone Company (SWBT) filed a motion for administrative stay pending reconsideration of the Commission's decision to preempt the Texas Centrex "continuous property restriction" regarding Centrex resale. SWBT contends that the Commission did not have the benefit of all the salient facts at the time it rendered its decision, and thus argues that it is likely to prevail in its related request for reconsideration also filed on October 31. SWBT also contends that it will suffer irreparable harm in the absence of a stay, and that grant of a stay will not harm other interested parties. In addition, SWBT argues that a stay would serve the public interest. SWBT requests that the Commission act on its motion by November 26, 1997. Interested parties are to file an original and six copies of their comments on SWBT's motion for administrative stay by November 12, 1997, with the Secretary, FCC, 1919 M Street, N.W., Washington, D.C. 20554. (We waive section 1.45 of the Commission's rules insofar as it permits reply comments.)
