              ORDER DENYING A WAIVER OF SECTIONS 
          36.611 AND 36.612 OF THE COMMISSION'S RULES

     On March 23, 1998, Accipiter Communications, Inc. ("Accipiter"), filed an Application for
Review requesting that the Commission review and reverse the decision of the Accounting and Audits
Division denying Accipiter's petition for waiver of Sections 36.611 and 36.612 of the Commission
rules.  
 
     Interested parties may file comments on the petition on or before May 6, 1998, and reply
comments on or before May 21, 1998, with the Secretary, Federal Communications Commission,
1919 M Street, N.W., Room 222, Washington, D.C. 20554.  Comments and reply comments should
reference AAD 96-96.  An original and nine (9) copies of each pleading should be sent to the
Secretary, Federal Communications Commission, 1919 M Street, N.W., Room 222, Washington,
D.C., 20554.  A copy of the application should also be sent to Andrew Mulitz, Legal Branch,
Accounting and Audits Division, Common Carrier Bureau, and to the Commission's contractor for
public service record duplication:  International Transcription Service (ITS), 1231 20th Street, N.W.,
Washington, D.C. 20036.  Copies of the application for review may be obtained from the Accounting
and Audits Division's public reference room, Room 812, 2000 L Street, N.W., Washington, D.C.
