The Order sets out the requirements regarding the ability of requesting carriers to use combinations of unbundled network elements (UNEs) to provide local exchange and exchange access service prior to the Commission's resolution of the Fourth Further Notice of Proposed Rulemaking in this docket. Pursuant to 47 C.F.R.  1.3 and paragraph 23 of the Order, WorldCom petitions for a waiver of three provisions of the Order so that it may convert local circuits leased under the incumbent local exchange carriers' special access tariffs to UNE combinations. These provisions are (1) the restriction on co-mingling of loops or loop-transport combinations with tariffed special access services; (2) the local usage requirements contained in the so-called "safe harbor" provisions of the Order that determine the minimum amount of local exchange service that a requesting carrier must provide in order for it to be deemed "significant," and (3) the collocation requirements contained in the "safe harbor" provisions. WorldCom also seeks a rebuttable presumption that any circuit that terminates at one of its "Class 5" local switches is a local circuit subject to the terms of the waiver. This matter shall be treated as a "permit-but-disclose" proceeding in accordance with the Commission's ex parte rules. See 47 C.F.R.  1.1200, 1.1206. Persons making oral ex parte presentations are reminded that memoranda summarizing the presentations must contain summaries of the substance of the presentations and not merely a listing of the subjects discussed. More than a one or two sentence description of the views and arguments presented is generally required. See 47 C.F.R.  1.1206(b). Other rules pertaining to oral and written ex parte presentations in permit-but-disclose proceedings are set forth in section 1.1206(b) of the Commission's rules, 47 C.F.R.  1.1206(b). Interested parties may file comments regarding WorldCom's waiver petition no later than October 2, 2000. Reply comments may be filed no later than October 10, 2000.
