Report No. SPB-95August 13, 1997 Clarification and Corrections to Public Notices Report Nos. SPB-88 and SPB-89 establishing deadlines for applications, letters of intent, and amendments to applications in the 2 GHz and 36-51.4 GHz Frequency Bands. The following corrections and clarifications should be noted: (1) We clarify that Part 25 of the Commission's rules no longer requires prior construction authority for entities seeking to construct, launch and operate satellite systems. Accordingly, applicants are not required to file an application fee for authority to construct a space station. To be considered as part of a processing round, U.S. applicants are required to apply for and file corresponding fees for launch and operating authority as set forth in Section 1.1107 of the Commission's rules, 47 C.F.R.  1.1107. Thus, proposals for non-geostationary satellite systems would file the fee listed for "Space Stations (Low Earth Orbit Satellite Systems)" on a per system basis (see 47 C.F.R.  1.1107(10)(b)) and proposals for geostationary satellite systems would file the fee listed for "Space Stations (Geostationary)" on a per satellite basis (see 47 C.F.R.  1.1107(9)(b)(1)). Pursuant to Section 1.1117 of the Commission's rules, 47 C.F.R.  1.1117, requests for waiver of fees will be considered on a case-by-case basis. In addition, entities filing letters of intent need not file application fees with their proposals. (2) Report No. SPB-89 is amended to reflect the following corrections. The correct file numbers for Motorola's M-Star application are 157-SAT-P/LA-96(72) and 29-SAT-AMEND-97 (not 19- SAT-AMEND-96). Comments or petitions regarding Motorola's M-Star application may be filed on or before August 21, 1997. Replies and oppositions may be filed may be filed on or before September 2, 1997. Responses may be filed on or before September 9, 1997 (not September 8, 1997). (3) The following paragraphs replace the "Filings" section in both notices and, as indicated below, we find that the clarifications in this Erratum warrant extending the deadline for applications in both the 40 GHz and 2 GHz frequency bands: "Each conforming amendment, new application, or letter of intent must include a concrete, comprehensive proposal for its proposed system, describing in detail all pertinent technical, operational and ownership aspects of the system and its ability to proceed expeditiously with construction and launch. This should include the information specified in Section 25.114 of the Commission's Rules, 47 C.F.R.  25.114, as amended by the Commission's Part 25 Streamlining Order, including appropriate information related to any feeder link and telemetry, tracking, and control requirements. Our rules require financial information for the following satellite services: (a) fixed-satellite service regardless of frequency band (Section 25.140(b)-(e)); (b) non-voice, non-geostationary satellite mobile satellite service ("Little LEO Satellite Service") (Section 25.142(a)(4)); and (c) 1.6/2.4 Mobile-Satellite Service ("Big LEO Satellite Service") (Section 25.143(b)(3)). Our rules do not yet require financial information for other mobile-satellite services (e.g. 2 GHz MSS). Entities submitting applications or letters of intent for services not currently covered under our rules need not file information to demonstrate financial qualifications at this time. Further, we highlight here two other caveats in providing the information required by Section 25.114. First, applicants seeking to use a non-U.S. licensed satellite to serve the United States need not file financial information in cases where the non-U.S. satellite is in-orbit and operating, even if the information is required for that service under our rules. Second, where international coordination for the non-U.S. licensed satellite has been completed through the International Telecommunication Union ("ITU") and the network has been notified to the ITU, applicants need not file the technical information specified in Section 25.114(c)(5) through 25.114(c)(12), unless the technical characteristics of the proposed system or service differ from the characteristics established in the ITU coordination process. Pursuant to Section 25.155 of the Commission's rules, 47 C.F.R.  25.155, interested parties wishing to file: (1) amendments to existing U.S. space station applications, (2) new U.S. space station applications, (3) earth station applications, or (4) letters of intent to use non-U.S. licensed space stations to be considered in the first 2 GHz and 40 GHz processing rounds must do so on or before September 5, 1997. Proposals that fail to provide all required information in their filings or fail to include the appropriate filing fee as of the cut-off date will be dismissed as unacceptable for filing. Applicants filing by the cut-off date will be afforded an opportunity to amend their applications, if necessary, to conform with any requirements and policies that may be adopted subsequently for space stations for the provision of service in these bands."
