These applications are not subject to the streamlined processing procedures set forth in Section 63.12 of the Commission's Rules, 47 C.F.R. Section 63.12. They will be acted upon only by formal written order of the Commission, and operation may not commence except in accordance with such order. See Section 63.12(d) of the Rules, 47 C.F.R. ITC-97-162 PACIFIC BELL COMMUNICATIONS Global Facilities based Services Application for authority to provide service in accordance with the provisions of Section 63.18(e)(1) of the rules. PBComm is a wholly-owned subsidiary of Pacific Telesis Group (PacTel). This application covers traffic originating in PacTel's "in-region" states. PBComm has requested that this authority become effective automatically for a given in-region state upon grant of Section 271 authority to provide inter-LATA services within that state. Commenters should limit their comments in this proceeding to issues specific to PBComm's request for authorization under Section 214 to provide international facilities-based services. Issues related to whether PacTel has met the criteria under Section 271 for entry into in-region inter-LATA (including international) services will be addressed in the context of proceedings initiated under Section 271. ITC-97-161 PACIFIC BELL COMMUNICATIONS Global Resale Services Application for authority to provide service in accordance with the provisions of Section 63.18(e)(2) of the rules. PBComm is a wholly-owned subsidiary of Pacific Telesis Group (PacTel). This application covers traffic originating in PacTel's "in-region" states. PBComm has requested that this authority become effective automatically for a given in-region state upon grant of Section 271 authority to provide inter-LATA services within that state. Commenters should limit their comments in this proceeding to issues specific to PBComm's request for authorization under Section 214 to provide international resale services. Issues related to whether PacTel has met the criteria under Section 271 for entry into in-region inter-LATA (including international) services will be addressed in the context of proceedings initiated under Section 271. Unless otherwise specified, interested parties may file comments with respect to these applications within 28 days of the date of this public notice. CORRECTIONS Pursuant to Section 63.12(c)(4) of the Commission's Rules, the application of Alaska Network System, Inc. ITC-97-099, has been re-classified as non-streamlined processing and will be acted on by formal written order. This application was listed as subject to streamlined processing in the February 28, 1997 public notice, Report TEL-70-A. REMINDER: Applicants must certify that neither the applicants nor any party to the application is subject to a denial of federal benefits by Federal and/or state courts under authority granted in 21 U.S.C. The Commission recently amended its Part 63 rules in IB Docket No. 95-118, Streamlining the International Section 214 Authorization Process and Tariff Requirements, FCC 96-79, released March 13, 1996 (61 Fed. Reg. 15724 (4/9/96)) (Streamlining Order) This order reduced the information that applicants are required to submit in support of their international Section 214 and cable landing license applications. It also modified the Commision's Section 214 authorization process and simplified the tariff filings required of nondominant international carriers. Applicants are advised to review the new rules, which became effective June 13, 1996. These rules are contained in Appendix A to the Commission's order. The rules adopted in the Streamlining Order renumbered many of the rules adopted in IB Docket No. 95-22, Market Entry and Regulation of Foreign- affiliated Entities Report and Order 11 FCC Rcd 3873 (1995) (60 Fed. Reg. 67332)(Foreign Carrier Entry Order. An applicant's failure to disclose required information could constitute grounds for denial of authorization or, in certain circumstances, result in fines and forfeitures.
