Washington, D.C. 20554 DA 98-267 February 12, 1998 INTERNATIONAL BUREAU SE EKS COMMENT ON REQUEST FOR WAIVER OF S ECTION 63.10(C)(2) BY TELECOM NEW ZEALAND LIM ITED File No. ISP-98-002 On February 6, 1998, Telecom New Zealand Limited (TNZL) filed a request for temporary waiver of Section 63.10(c)(2) of the Commission's rules. Section 63.10(c)(2) requires that any carrier classified as dominant on a particular route, for the provision of particular services, must provide such services as an entity that is separate from its foreign carrier affiliate. The authorized dominant carrier must maintain separate books of account from its foreign affiliate and cannot jointly own transmission or switching facilities with its foreign affiliate. TNZL is authorized under Section 214 of the Communications Act of 1934, as amended, to provide international services between the United States and foreign points, and is regulated as a dominant carrier with respect to the U.S.-New Zealand route. TNZL has requested a temporary waiver of the Section 63.10(c)(2) requirements until no later than April 1, 1998. TNZL states that this will permit it to make the necessary internal changes coincident with the end of its fiscal year on March 31, 1998. Interested parties may file comments regarding this request no later than February 26, 1998. Reply comments may be filed no later than March 10, 1998. All filings should refer to File No. ISP-98-002. In accordance with Section 1.51(c) of the Commission's rules, an original and four copies of all pleadings must be filed with the Secretary at the above address. In addition, one copy of each pleading must be filed with: (1) International Transcription Services, Inc.
