The Commission has before it for consideration the Notice of Proposed Rule Making, 11 FCC Rcd 12793 (1996), proposing the allotment of Channel 290A to Belview, Minnesota, as that community's first local broadcast service. The Notice was issued in response to a petition filed by Harbor Broadcasting, Inc. ("Harbor"). Harbor filed comments in response to the Notice. No other comments were received. 2. Harbor continues to support the allotment of Channel 290A at Belview, as the community's first local broadcast service. Harbor has stated its intention to file an application for a construction permit to activate the channel at Belview, and if granted, will promptly construct the facility. Harbor indicated that Belview is listed in the 1990 U. S. Census, is incorporated with numerous businesses and has its own post office and zip code. The community has a fire department and ambulance service and the State of Minnesota has included Belview in its list of Certified Local Governments. 3. We believe the public interest would be served by allotting Channel 290A to Belview, Minnesota, as it will provide the community with its first local transmission service. Channel 290A can be allotted to Belview in compliance with the minimum distance separation requirements of the Commission's Rules provided there is a site restriction 12.4 kilometers (7.7 miles) northeast of the community. The site restriction will prevent a short spacing to Station KJOE, Channel 291C2, Slayton, Minnesota. 4. Accordingly, pursuant to the authority contained in Sections 4(i), 5(c)(1), 303(g) and (r) and 307(b) of the Communications Act of 1934, as amended, and Sections 0.61, 0.204(b) and 0.283 of the Commission's Rules, IT IS ORDERED, That effective March 17, 1997, the FM Table of Allotments, Section 73.202(b) of the Commission's Rules, IS AMENDED for the community listed below, as follows: Community Channel No. Belview, Minnesota 290A 5. The window period for filing applications for Channel 290A at Belview, Minnesota, will open on March 17, 1997, and close on April 17, 1997. 6.
