The Commission has before it an Application for Review filed by David A. Ringer ("Ringer") directed to the Memorandum Opinion and Order in this proceeding. 10 FCC Rcd 11074 (1995). Nelsonville TV Cable, Inc. ("Nelsonville") filed an Opposition to Application for Review. For the reasons discussed below, we dismiss the Application for Review. 2. The Report and Order in this proceeding allotted Channel 240A to Athens, Ohio. 9 FCC Rcd 507 (1994). Thereafter, Ringer filed a Petition for Reconsideration directed against a separate staff Order opening an additional filing window for this allotment. The Memorandum Opinion and Order in this proceeding denied that Petition for Reconsideration. On December 13, 1995, Ringer, along with the other mutually exclusive applicants for this allotment filed a Joint Request for Approval of Settlement Agreement. The Joint Request was approved on September 23, 1996, and a construction permit was granted to Christian Faith Broadcasting, Inc. (File No. BPH-950123MA). 3. On February 18, 1997, Ringer filed a pleading requesting dismissal of his Application for Review. As requested, we will dismiss the Application for Review. 4. Accordingly, the aforementioned Application for Review filed by David A. Ringer IS HEREBY DISMISSED. 5. IT IS FURTHER ORDERED, That this proceeding IS TERMINATED. 6.
