  By the Chief, Allocations Branch:
  
  1.  The Commission has before it for consideration the Notice of Proposed Rule Making, 12
  FCC Rcd 1273 (1997), issued in response to a petition filed by Queso Broadcasting Company
  ("Queso").  The Notice proposed the allotment of Channel 281A to Pinconning, Michigan, as that
  community's second FM broadcast service.  Queso filed comments reaffirming its interest in the
  allotment of Channel 281A at Pinconning.  No other comments were received at the Commission
  in response to the Notice.
  
  2.  We believe the public interest would be served by allotting Channel 281A to Pinconning,
  Michigan, as it will provide the community with its second FM transmission service.  Channel
  281A can be allotted to Pinconning consistent with the minimum distance separation requirements
  of the Commission's Rules provided there is  a site restriction 4.5 kilometers (2.8 miles) northeast
 of the community.   The site restriction will prevent a short spacing to Station WKQZ, Channel
  227C2, Midland, Michigan.  Since Pinconning is located within 320 kilometers (200 miles) of the
  U.S.-Canadian border, concurrence of the Canadian government has been obtained for this
  allotment.
  
  3.  Accordingly, pursuant to the authority contained in Sections 4(i), 5(c)(1), 303(g) and (r)
  and 307(b) of the Communications Act of 1934, as amended, and Sections 0.61, 0.204(b) and
  0.283 of the Commission's Rules, IT IS ORDERED, That effective June 23, 1997,  the FM Table
  of Allotments, Section 73.202(b) of the Commission's Rules, IS AMENDED for the community

    4.  The window period for filing applications for Channel 281A at Pinconning, Michigan,
    will open on June 23, 1997, and close on  July 24, 1997.
    
    5.  IT IS FURTHER ORDERED, That this proceeding IS TERMINATED.
