The Notice was issued in response to a petition filed by Mountain Tower Broadcasting ("Mountain"). Mountain filed comments reiterating its intention to apply for Channel 298A at Superior. No other comments were received at the commission in response to this proposal. 2.In response the Commission's request for additional information concerning site availability, Mountain informs us that it has contacted local officials who have identified commercial structures and areas such as the fair grounds which could be utilized for an FM transmission location. Mountain feels confident that it will have no problem identifying an actual site, particularly since no site restrictions have been imposed on Channel 298A at Superior. Mountain further states that if it is awarded a construction permit for Channel 298A at Superior, it will expeditiously construct the station. 3.We believe the public interest would be served by allotting Channel 298A to Superior, Montana, since it will provide the community with its first local broadcast service. As indicated in the Notice, Channel 298A can be allotted to Superior in compliance with the Commission's spacing requirements without a site restriction. Since the community of Superior is located within 320 kilometers (200 miles) of the U.S.-Canadian border, concurrence of the Canadian Government has been obtained for this allotment. 4.Accordingly, pursuant to the authority contained in Sections 4(i), 5(c)(1), 303(g) and (r) and 307(b) of the Communications Act of 1934, as amended, and Sections 0.61, 0.204(b) and 0.283 of the Commission's Rules, IT IS ORDERED, That effective August 11, 1997, the FM Table of Allotments, Section 73.202(b) of the Commission's Rules, IS AMENDED for the community listed below, as follows: CommunityChannel Number Superior, Montana 298A 5.The window period for filing applications for Channel 298A at Superior, Montana, will open on August 11, 1997, and close on Sepember 11, 1997. 6.
