NEWSReport No. DC 95-134 ACTION IN DOCKET CASE November 28, 1995 FCC ADOPTS NEW ANTENNA STRUCTURE REGISTRATION PROCEDURES AND RULES TO GOVERN CONSTRUCTION, MARKING, AND LIGHTING (WT DOCKET NO. 95-5) The Commission has adopted a new streamlined procedure under which owners will register radio antenna structures that require clearance by the Federal Aviation Administration (FAA) and special painting and lighting because of aviation safety concerns. In addition, the Commission has revised the painting and lighting requirements in Part 17 of its rules to conform to the specifications set forth in two recent FAA Advisory Circulars on the marking and lighting of towers. By today's action, the Commission establishes a streamlined process under which each antenna structure will be registered by its owner rather than by each individual licensee that uses the structure. The owner will be the single point of contact for resolving antenna- related problems and the burdens previously associated with the antenna structure clearance process will be substantially reduced both for the Commission and licensees. Today's action will increase the safety of air navigation by designating a single point of contact with whom the FAA and the FCC may communicate when there are emergency situations or incidents of non-compliance with the lighting and painting specifications for antenna structures. Under the Commission's new antenna clearance procedures, beginning July 1, 1996, the Commission will require the owners of all proposed antenna structures requiring FAA notification or of existing structures with alterations requiring FAA notification to register such structures with the FCC prior to the proposed construction or alteration. The Commission will also establish a phased two-year window for registration of all existing structures (i.e., all structures constructed prior to July 1, 1996) that require FAA notification.
